Summary / Abstract:

LTĮvairios teisės šakos ir teisės normų taikymo praktika, net teisės mokslas patiria vis didesnį Konstitucijos, jos vertybių poveikį. Konstitucija vis labiau skverbiasi į visą teisinį gyvenimą. Šis reiškinys vadinamas teisės konstitucionalizacija. Kolektyvinės darbo teisės konstitucionalizacijos laipsnis Lietuvoje nėra didelis, tačiau ir kolektyvinėje darbo teisėje galima pastebėti vis labiau ryškėjantį konstitucinių imperatyvų poveikį. Straipsnyje, analizuojant Konstitucijos 35, 50 ir 51 straipsnių nuostatas ir jų interpretavimą Konstitucinio Teismo jurisprudencijoje, yra atskleidžiami atskirų kolektyvinės darbo teisės institutų konstitucionalizavimo aspektai. Nagrinėjant asociacijų laisvės principą, aptariama tarptautinių teisės aktų ir konstitucinė šio principo samprata. Oficiali asociacijų laisvės principo konstitucinė doktrina plėtojama Konstitucinio Teismo jurisprudencijoje, kurioje yra suformuluota principinė nuostata, kad asociacijų laisvė yra konstitucinė vertybė, o Konstitucijoje nustatyta teisė į susivienijimus, arba asociacijų laisvė, – tai viena iš pilietinio ir politinio veikimo garantijų. Asociacijų laisvės principo turinys oficialiojoje Konstitucinio Teismo doktrinoje interpretuojamas pozityviuoju ir negatyviuoju aspektais. ENDifferent branches of law and the practice of application of legal norms and even the science of law have been experiencing an increasing impact of the Constitution and its values. The Constitution has been increasingly penetrating in the entire legal domain. This phenomenon is called the constitutionalization of law. The degree of constitutionalization of the collective labour law is not high in Lithuania, yet the impact of constitutional imperatives has become more evident in the collective labour law. When analysing the provisions of Articles 35, 50 and 51 of the Constitution and their interpretation in the jurisprudence of the Constitutional Court, the paper reveals the aspects of constitutionalization of individual collective labour law institutions. When examining the principle of the freedom of association, the paper discusses the concept of international legal acts and the constitutional concept of this principle. The official constitutional doctrine of the principle of the freedom of association is developed in the jurisprudence of the Constitutional Court, which has formulated the principled provision that the freedom of association is a constitutional value and one of the guarantees of civil and political action. The content of the principle of the freedom of association is interpreted in the official doctrine of the Constitutional Court from both positive and negative aspects. When interpreting the principle of the freedom of association from the negative aspect, it has been stated that the Constitution guarantees the right to voluntarily decide whether to belong to any association; a person exercises this constitutional right at free will which is the underlying principle of membership of associations.
