LTStraipsnyje analizuojamos vaikų grobimo Europos Sąjungos valstybėse narėse atvejais taikomos teismingumo nustatymo taisyklės, įtvirtintos 2003 m. lapkričio 27 d. Europos Tarybos reglamente (EB) Nr. 2201/2003 dėl jurisdikcijos ir teismo sprendimų, susijusių su santuoka ir tėvų pareigomis, pripažinimo bei vykdymo (sutrumpintai vadinamas Reglamentu Briuselis Ha arba Briuselis llbis), taip pat Reglamento Briuselis Ha ir 1980 m. Hagos konvencijos „Dėl tarptautinio vaikų grobimo civilinių aspektų" bei šiuos tarptautinės teisės aktus įgyvendinančio 2008 m. lapkričio 13 d. Lietuvos Respublikos civilinį procesą reglamentuojančių Europos Sąjungos ir tarptautinės teisės aktų įgyvendinimo įstatymo nuostatos, reglamentuojančios pagrobtų vaikų grąžinimą bei praktinės jų taikymo problemos. ENThis article examines the rules of jurisdiction in the cases of child abduction within the Member States of the European Union, which arc established in Regulation Brussels Ila, as well as the provisions of Regulation Brussels Ila, 1980 Hague Convention on International Child Abduction and 13 November 2008 Law of the Republic of Lithuania, implementing the acts of European Union and international law, regulating civil process, those instruments of international law, regulating the return of abducted children and practical problems of their application. Author proposes a concept of international child abduction within the European Union, and pays not little attention to the basic criteria which are formulated by the European Court of Justice of determination the child's habitual residence. The article thoroughly examines the rules which arc established in the Regulation Brussels Ha and the Hague Convention for hearing the cases of children return. Also the rules adopted in 13 November 2008 Law of the Republic of Lithuania, implementing the acts of European Union and international law, regulating civil process, which implement Brussels Ila Regulation and the Hague Convention, are discussed.Significance and importance of the principle of hearing a child and the party requesting the return of a child are emphasized. The cases when a court can refuse to return a child and new rules of the Regulation, restricting the exceptions of the refusal to return a child established in the Hague convention, are discussed with reference to the Klentzeris v. Klentzeris case. The importance of the rapidity of the appellate procedures concerning the cases of child return is highlighted. After analyzing the views of different institutions and the legal regulation, a conclusion of no need of cassation in the proceedings of hearing the child return cases is made. In addition, it is noted that a legally advantaged position with the help of Article 20 of the Regulation cannot be secured to the parent abductor. [From the publication]
