Konstitucija, teismai ir demokratija : Egidijus Kūris
LTKonstituciją iš kitų teisės aktų išskiria ne tik jos viršenybė, bet ir stabilumas. Vertinant, ar dabartinė Konstitucija atlaikė laiko išbandymus ir kaip ji juos at laikė, derėtų palyginti, ką ji užtikrino iš to, ko negalėjo užtikrinti ankstesnė laikinoji konstitucinė tvarka. Konstitucija yra priemonė, leidžianti pilietinei Tautai - valstybinei bendruomenei kontroliuoti valdžią. Kartu Konstitucija yra antimažoritarinis aktas, ginantis mažumą, net individą nuo daugumos diktato. Konstitucijos apibūdinimas kaip visuomenės sutarties atspindi vieną iš giluminių Konstitucijos, kaip Tautos akto ir aukščiausiosios krašto teisės, prasmių. Tačiau, anot autoriaus Konstitucijoje įtvirtintas platus žmogaus teisių katalogas, nereiškia, jog tų teisių visada paisoma. Tai menkina pasitikėjimą Konstitucija ir iniciatyvas ją koreguoti skatina ne mažiau nei kai kurių interesų grupių siekis nustatyti tokį alternatyvų konstitucinį reguliavimą, kuris garantuotų jų partikuliaraus intereso viršenybę prieš bendrąjį. Straipsnyje pateikiama kai kurių siūlymų keisti Konstitucijos nuostatas kritika: Seimo narių skaičiaus mažinimas, Seimo narių atšaukimas, Prezidento galios stiprinimas ir pan. Teigiama, jog kai kurie iš šių siūlymų yra atvirai populistiniai, iš pažiūros jais siekiama užtikrinti daugiau demokratijos, bet iš tikrųjų jie prieštarauja europinei demokratijos tradicijai ir vien dėl to vertintini kaip destruktyvūs. ENThe Constitution differs from other legal acts not only in its supremacy but also in its stability. To evaluate whether the present Constitution has withstood the test of time and how it has done it, one must make a comparison of what it has ensured that could not have been ensured by the previous temporary constitutional order. The Constitution is a tool through which a civil nation – a state community – can control the government. At the same time the Constitution is an anti-majoritarian act, protecting a minority, even an individual, against the dictatorship of the majority. Description of the Constitution as a contract of society reflects one of the deep meanings of the Constitution as the Act of Nation and the Supreme National Law. However, according to the author, a wide catalogue of human rights enshrined in the Constitution does not mean that these rights are always adhered to. This diminishes trust in the Constitution and encourages initiatives to amend it as much as the aspirations of certain interest groups to establish an alternative constitutional regulation which would guarantee the supremacy of their particular interest over the general interest. The article provides criticism of a few proposals to amend provisions of the Constitution, such as, reducing the number of Parliament members, revoking Parliament members, increasing the power for the President, etc. It is stated that certain proposals are clearly populist – at first sight they are designed to better ensure democracy, but in fact they contradict the European democratic tradition and because of that alone they are to be considered as destructive. One of the guarantors of the State constitutional protection framework is a constitutional justice, i.e. a constitutional control and interpretation of the Constitution.
