Žalos pacientams kompensavimo ypatumai sveikatos teisėje : disertacija

LTLietuvos teisės doktrinoje tai pirmas išsamus kompleksinis tyrimas, atskleidžiantis pacientų teisės į žalos atlyginimo ypatumus sveikatos teisėje. Disertacijos tikslas - išanalizuoti specialiųjų žalos pacientams kompensavimo sistemų ypatumus, įvertinti paciento teisės į žalos atlyginimą teikiamos teisinės apsaugos veiksmingumą Lietuvoje, apsvarstyti sveikatos teisės institutus, darančius įtaką žalos pacientams kompensavimo sąlygų kitimui bei pateikti siūlymus, kaip teisinėmis priemonėmis patobulinti žalos pacientams kompensavimą Lietuvoje. Pirmojoje darbo dalyje pagrindžiamas specialiųjų žalos pacientams kompensavimo sistemų įdiegimo aktualumas, analizuojama Lietuvos Respublikos pacientų teisių ir žalos atlyginimo įstatymo reglamentuota, bet neįgyvendinta specialioji žalos pacientams kompensavimo sistema. Antrojoje darbo dalyje analizuojamas specialiųjų žalos pacientams kompensavimo sistemų reguliavimas ir jo raida valstybėse turinčiose ilgiausią šių sistemų taikymo patirtį (Naujosios Zelandijos, Švedijos, Suomijos, Danijos). Remiantis šių šalių sistemų lyginamąja analize pagrindžiami siūlymai dėl galimo specialiosios žalos pacientams kompensavimo sistemos modelio Lietuvoje. Trečiojoje dalyje atskleidžiama atskirų sveikatos teisės institutų - informuoto paciento instituto ir paciento pareigų - įtaka žalos paciento kompensavimo sąlygų kitimui, jų reglamentavimo, taikymo ypatumai, raida. Disertacijos atlikto tyrimo rezultatas - trys išvados ir siūlymai dėl specialiojo žalos pacientams kompensavimo modelio Lietuvoje, taip pat siūlymai dėl Lietuvos Respublikos pacientų teisių ir žalos sveikatai atlyginimo įstatymo tobulinimo ir taikymo.

ENIn the doctrine of Lithuanian law, it is the first comprehensive complex analysis that reveals the features of the patients' rights to compensation established in the health law. An aim of the thesis is to analyse the features of the special damage compensation systems to the patients, to evaluate the effectiveness of the patients' rights to a compensation in Lithuania and the legal institutes of health that have influence to the conditions of the damage compensation to the patients, and to provide suggestions in order to improve the system of damage compensation to the patients in Lithuania. The first part of the work is about the necessity to implement special damage compensation systems to the patients. It also analyses the law of Lithuania that regulates but does not implement the special damage compensation systems to the patients. The second part analyses the regulation of the special damage compensation systems to the patients and its development in the states that have the longest experience of the implementation of the systems (New Zealand, Sweden, Finland, Denmark). With reference to a comparative analysis of these states, the reasons for the implementation of the systems are given. The third part reveals the influence of different health institutes (the informed institute of the patient and the responsibilities of the patient) to the change of the conditions of the compensation, its regulation, implementation and development. The result of the analysis of the thesis is the following: three conclusions and suggestions for the model of the special damage compensation systems to the patients in Lithuania, also, a suggestion how to improve and implement the law on the patients' rights and the health damage compensation of the Republic of Lithuania are given.
