LTKiekvienas dirbantis žmogus turi teisę turėti poilsį ir laisvalaikį, taip pat kasmetines mokamas atostogas. Poilsio laikas – tai įstatymu, kolektyvine ar darbo sutartimi reglamentuotas laisvas nuo darbo laikas, per kurį darbuotojas pagal galiojančius įstatymus, darbo, kolektyvines sutartis ir vidaus darbo tvarkos taisykles neturi atlikti darbinių funkcijų. Lietuvai įstojus į ES, ypač aktuali ir svarbi tampa 93/104 ES direktyva ,,Dėl tam tikrų darbo laiko organizavimo aspektų“. Ji įpareigoja valstybes užtikrinti, kad kiekvienas darbuotojas turėtų teisę į minimalų 11 valandų kasdienio nenutrūkstamo poilsio laiką, o per 7 dienas – teisę į minimalų 24 valandų nenutrūkstamo poilsio laiką. Siekiant atskleisti poilsio laiko organizavimo reikšmę viešajame sektoriuje Kauno savivaldybės administracijoje 2006 m. rugsėjį-gruodį buvo atlikta administracijos darbuotojų apklausa. Galima teigti, jog Kauno savivaldybės administracijos vadovybė per mažai dėmesio skiria darbuotojų informavimui apie poilsio laiką reglamentuojančius įstatymus, todėl darbuotojams kyla problemų dėl poilsio laiko paskirstymo bei organizavimo, jie taip pat nepatenkinti kasmetinių atostogų skyrimo tvarka. Didžioji darbuotojų dalis dėl per didelio darbo krūvio panaudoja tik dalį jiems priklausančio poilsio laiko. Todėl darbdavys turėtų imtis priemonių darbuotojų poilsiui užtikrinti. Reikėtų išsiaiškinti, kodėl darbuotojai nespėja susidoroti su darbo krūviu, o po to bandyti šalinti problemą. Galbūt darbuotojai dirba po darbo valandų dėl nepakankamos kvalifikacijos, patirties stokos, sveikatos problemų ar pan.

As the right to rest is a constitutional right of each working person, and its implementation is foreseen by particular standard deeds, so an employer must provide all necessary and comprehensive information for his employees about the laws of the Republic of Lithuania, which regulate rest time and their changes and negotiate comfortable conditions in a workplace. 2. Kaunas district municipality administration direction pays too little attention to conveyance of employees about the laws of the Republic of Lithuania, which fix rest time and their changes that is why the employees have problems with allocation and organization of their rest time, they also are not satisfied about the order of annual holiday delivering. 3. A bigger part of Kaunas district municipality administration employees use only a part of the rest time, which belongs to them because of immoderate workload. In such a situation, the employer should start to assume measures to secure rest time for the employees. Firstly, it would be necessary to find out why the employees cannot cope with the workload in time and after that try to eliminate the problem. It may be that employees must work overtime because of insufficient qualification, a lack of experience or because of health problems, etc.4. According to the laws of the Republic of Lithuania annual holidays are provided to each working person. In Kaunas district municipality administration the time of annual holidays is established by obeying the laws of the Republic of Lithuania, which regulate the order of rest time and by making agreements between employees themselves. The order of rest time establishment creates various problems for many employees. As the laws define a priority list of employees who may select holiday time, so the best way trying to solve these problems is to rely on the employees’ benevolence and consciousness, because it is impossible to satisfy requests of all employees. 5. The rest time organization in Kaunas district municipality administration is satisfactory: the laws and acts, which regulate work and rest time, are followed, but the rest time organization mostly depends on the attitude of the leader to working people, to their health. 6. While taking care of the efficiency of rest time organization by his/her employees, each leader of any organisation should also regard the opinion of employees about the existing order of rest time organization, discuss their offers and wishes how to improve the rest time organization; as such offers might help to take more reasonable decisions.
