Prezidento institucijos teisė perduoti Seimo priimtus teisės aktus tautos referendumui

LTGaliojanti Lietuvos Respublikos (LR) Konstitucija nenumato Respublikos Prezidento teisės perduoti Seimo priimtus teisės aktus perduoti tautos referendumui. Straipsnyje aptariama tokios valstybės vadovo teisės įtvirtinimo praktika istoriniame ir šiuolaikiniame užsienio valstybių kontekste, analizuojami šios teisės įtvirtinimo privalumai bei galimi pavojai. Nagrinėjamas šios teisės santykis su valstybės vadovo veto teise bei teise kreiptis į Konstitucinį Teismą dėl įstatymų atitikimo Konstitucijai. Straipsnio išvadose teigiama, kad prezidento teisė perduoti Seimo priimtus teisės aktus tautos referendumui yra teigiama teisinio reguliavimo institucija. Ji padėtų tautai, kaip konstitucinei institucijai, atgauti deramą vietą sprendžiant pagrindinius valstybės ir tautos gyvenimo klausimus. Jei Respublikos Prezidentui būtų suteikta neribota teisė perduoti Seimo priimtus įstatymus tautos referendumui arba skelbti referendumą dėl Seimo priimtų įstatymų, jis įgytų labai stiprią poziciją prieš Seimą, kaip įstatymų leidėją. Todėl būtų racionalu tokią Respublikos Prezidento teisę šiek tiek apriboti. Tačiau kartu abejojama, ar LR Prezidento institucijai kada nors bus suteiktas įgaliojimas kreiptis į Konstitucinį Teismą dėl Seimo priimtų įstatymų atitikimo Konstitucijai ar teisė perduoti Seimo priimtus teisės aktus - Konstitucijos pakeitimus ir papildymus bei įstatymus - tautos referendumui, nes politinės partijos ir jų lyderiai nėra suinteresuoti stiprinti LR Prezidento instituciją.

ENThe valid Constitution of the Republic of Lithuania does not foresee the right for the President of the Republic to transfer legal acts, adopted by the Parliament to the nation for referendum. The article discusses the practice of consolidation of such a right of the leader of the country in the historical and modern context of foreign countries, analyzes the advantages and potential dangers of consolidation of such right, examines the relation between the right and the veto right of the leader of the country and the right to apply to the Constitutional Court regarding conformity of the laws to the Constitution. The conclusions of the article state that the President’s right to transfer the legal acts, adopted by the Parliament to the nation for referendum is a positive institution of legal regulation, which would help the nation, as a constitutional institution, to regain a proper place in resolution of the main issues of life of the state and the nation. In case the President of the Republic is granted the unlimited right to transfer the laws, adopted by the Parliament to the nation for referendum or convoke a referendum regarding the laws, adopted by the Parliament, he/she would get a very strong position with regard to the Parliament as the legislator. Therefore it is rational to limit such a right of the President of the Republic to a certain extent. However there are doubts whether the institution of the President of the Republic will ever be granted the authorization to apply to the Constitutional Court regarding the conformity of the laws, adopted by the Parliament to the Constitution or the right to transfer legal acts, adopted by the Parliament, i. e. amendments and supplementations to the Constitution and laws, to the nation for referendum, since political parties and their leaders are not interested in strengthening of the institution of the President of the Republic.
