Europos Sąjungos raidos tendencijų ir perspektyvų klausimu

LTStraipsnyje aptariami veiksniai, kuriantys šiuolaikinę Europos Sąjungą (ES), ir kartu tuose pačiuose veiksniuose įžvelgiamos pagrindinės grėsmės jos ateičiai. Aiškinamasi, kokios galimybės slypi teisėje stabilizuojant ES ir garantuojant jos raidą [...]. Atskleidžiamas socialinės teisinės valstybės kaip ES ideologinio, teisinio pagrindo vidinis prieštaringumas: pernelyg toli siekianti žmogaus teisių sauga apibrėžiama kaip naujai kylanti grėsmė toms pačioms žmogaus teisėms. Galimybė prognozuoti ES ateitį remiasi nuostata apie objektyviai egzistuojantį visų procesų vidinį prieštaringumą, jų "polinkį su laiku transformuotis į savo priešybes. Todėl tie patys veiksniai, kurie šiandien kuria ES [...], juos ėmus absoliutinti, anksčiau ar vėliau ims veikti prieš ją. Vienas iš tokių veiksnių, kuriančių ES ir kartu provokuojančių jos ateities problemas, yra ekonominio veiksnio pirmumas ir jį užtikrinanti "atvirų durų politika. [...] Socialinės valstybės skatinimas kartu virsta žmogaus-vartotojo skatinimu ir žmogaus-kūrėjo slopinimu su visomis iš to sekančiomis ekonomikos stagnacijos ir naujų socialinių įtampų pasekmėmis. Ateities problema, veikiančia dezintegracijos linkme, gali tapti ir Europos žmogaus teisių teismas, taip pat Europos teisingumo teismas, jei šie teismai ir toliau eis ES narių vertybinių tradicijų humanistikos srityje unifikavimo linkme. [...] ES turi daugiau galimybių plėtotis ne kaip centralizuotas, o kaip atskiromis sutartimis valdomas darinys, nors ES dalyvavimas globalioje konkurencijoje ir siekis ją laimėti reikalautų glaudesnės Sąjungos. ENThe article discusses the factors, creating the modern European Union (EU), envisages the main threats to the future of the EU, stipulated by the same factors and discusses the possibilities, which are provided by the legislation when stabilizing the EU and ensuring its appropriate development [...]. The article reveals the inner inconsistency of the ideological and legal basis of such a rule of law as the EU is: the far-reaching protection of human rights is defined as a new threat to the human rights themselves. The possibility to forecast the future of the EU is based by the position of the objectively existing inner conflict between all the processes and their inclinations to transform into their opposites with time. Therefore the same factors, which develop the EU today [...], in case they are made absolute, sooner or later are going to act against the EU. Among the said factors, developing the EU and, on the other hand, provoking its future problems, is the priority of the economic factor and “the open door policy”, which ensures the said priority. [...] The encouragement of a social state nurtures the consuming person and suppresses the creative person with all the consequences of stagnation of economy and new social tensions. The European Court of Human Rights and the European Court of Justice can become a problem in the future and act towards disintegration, in case the said courts continue to follow the direction of unification of the value traditions of the EU Member States in the humanistic area. [...] The EU has more development possibilities not as a centralized formation, but one, managed by separate agreements, although its participation in the global competition and strivings to be the leader require a more cohesive union.
