Summary / Abstract:

LTDisertacijoje pirmą kartą istorinėje teisės literatūroje nušviečiama visų nelietuviškų (baltarusių, ukrainiečių ir rusų) LDK žemių teisinė padėtis per visą LDK gyvavimo laikotarpį. Nagrinėjami vietos valdymo, savivaldos ir teisingumo vykdymo klausimai, aptariama centrinės valdžios politika nelietuviškų žemių atžvilgiu, atskleidžiamos jų gyventojų – bajorų, dvasininkų, valstiečių ir miestiečių – teisės ir pareigos. Didesnis dėmesys skiriamas XIV-XVI a. pirmajai pusei, nes šiuo laikotarpiu nelietuviškų LDK žemių plotas buvo didžiausias, o jų teisinės padėties ypatybės pasireiškė ryškiausiai. Autorius nustatė, kad nelietuviškos LDK žemės iki XVI a. vidurio naudojosi administracine ir teismine autonomija, kurios teisinį pagrindą sudarė LDK valdovų išleisti įstatymai ir jų sankcionuota vietos paprotinė teisė. 1564-1566 m. reformos suvienodino vietos valdymą ir teisingumo vykdymą visoje LDK teritorijoje, o kai kurios ypatybės, būdingos nelietuviškoms žemėms XVI a. antrojoje pusėje – XVIII a., nebeturėjo principinės reikšmės. 1432-1434 m. buvo sulygintos bajorų katalikų ir stačiatikių teisės. Stačiatikių ir Unitų bažnyčios buvo stambios žemvaldės, valstybė saugojo jų interesus ir nesikišo į jų vidaus reikalus. Nelietuviškose LDK žemėse valstiečių įbaudžiavinimas vyko lėčiau negu Lietuvoje, agrarinė reforma (vadinamoji valakų reforma) daugelyje šių žemių buvo įgyvendinta tik XVII a. pirmojoje pusėje. Pradedant 1390 m. nelietuviškiems LDK miestams buvo suteikiama savivalda vokiečių Magdeburgo miesto teisės pagrindu, šiuose miestuose susiklostė vietinės ir Magdeburgo teisės sintezė. [Iš leidinio]

ENThis is the first dissertation in the history of legal literature that considers all the non-Lithuanian land throughout the history of the Grand Duchy. It examines issues of land management, self-government and the enforcement of justice, discusses an overview of the central governing of non-Lithuanian land, and discovers the rights and duties of its inhabitants – the nobility, the clergy, the peasants and the town-dwellers. The greatest focus is on the period from the 14th century to the mid-16th centuries because the non-Lithuanian area of land was largest during this period and the features of the legal situation manifested themselves most clearly. The author establishes that until the middle of the 16th century, non-Lithuanian land was administratively and legally autonomous, the legal basis on which the Duchy passed laws and the area they were sanctioned in, was common law. The reforms of 1564-1566 made land management and the enforcement of justice uniform throughout the Duchy’s territory, and some features of non-Lithuanian lands from the mid-16th century to the 18th century were no longer significant. The noble Catholic and Orthodox laws were made equal from 1432-1434. The Orthodox and Uniate churches were strong land owners; the state protected their interests and did not interfere with its internal affairs. Serfdom came more slowly to non-Lithuanian land than it did in Lithuania: agrarian reform was implemented in most of these areas in the first half of the 17th century. From 1390, the non-Lithuanian towns in the Duchy were allowed to be self-governing on the basis of the Magdeburg rights. Local and Magdeburg rights became synthesized in these places.
