Probleminiai fiktyvios santuokos ar registruotos partnerystės aspektai

LTFiktyvi santuoka ar registruota partnerystė – tai papildomas pajamų šaltinis, galimybė pasilikti pageidaujamoje šalyje, tačiau tai neretai susiję ir su prekyba žmonėmis, prostitucija, prievartavimu ar terorizmu. Straipsnyje analizuojami fiktyvios santuokos, kaip pavojingo reiškinio, samprata, požymiai, problemos, nustatymo ypatumai teismų praktikoje. Analizė parodė, kad Lietuvoje apie tai turi būti daugiau diskutuojama, keliant baudžiamosios atsakomybės nustatymo klausimus, prevencinių priemonių, efektyvesnių tyrimo būdų taikymą, tarptautinio bendradarbiavimo vystymą.

ENMarriage of convenience or registered partnership is a way of making money, a chance to stay in desired country. But it is often associated with human trafficking, prostitution, rape or terrorism. The article analyzes the concept, particularities of case law and the problems of marriage of convenience as a dangerous phenomenon. Research has shown that there should be more discusions about it in Lithuania, legalizing criminal liability, rising preventive measures, developing international cooperation. The analysis of decisions of the Supreme Administrative Court of Lithuania showed that the Court does not always take into account the spouses surveys, often it takes only the results of the relatives surveys. On the other hand, the fact of marriage of convenience can be identify after a sufficiently long period, for example 5 years. It negates the requirement of long-term criteria denying the fact of a marriage of convenience.
