ENLithuania transposed Directive (EU) 2019/1 (the ECN+ Directive or the Directive) with sets of amendments of the Law on Competition within two years. Neither the Directive nor the transposition into national laws invoked any wider public discussions among practitioners, industry or academics. That is not astonishing as the Competition Council of Lithuania has been independent and enjoyed vast rights and powers before the Directive. Furthermore, the Council adheres to EU practices widely in its investigations and application of the competition rules. Even though the Directive strengthened the Council in general, the Directive brought no significant changes relevant to competition law enforcement. However, more and more worries arise regarding the balance of powers of the Council and rights of undertakings under investigation.
