Lietuvos vandens išteklių apsaugos ir valdymo pokyčiai
LTIntegracijos į Europos Sąjungą (ES) procesas ir Lietuvos tarptautiniai aplinkos apsaugos įsipareigojimai darė esminę įtaką ir vandens išteklių apsaugos politikos formavimui, įtvirtino principus ir reikalavimą derinti teisės aktus prie ES egzistuojančių normų. Darbo tikslas - įvertinti vandens išteklių apsaugos ir valdymo sistemos pokyčių nulemtus pranašumus ir trūkumus bei pasiūlyti galimus problemų sprendimo būdus. Lietuvos vandens išteklių apsaugos ir valdymo sistemos komplikuotumą nulėmė keleriopi raidos faktoriai: paveldėta neefektyvi aplinkosaugos sistema, upių baseinų nesutapimas su valstybių sienomis, Europos teisės reikalavimų fragmentiškumas, skirtingos prigimties ūkiniai poveikiai pačių vandens išteklių būklei, stambių investicijų - ypač į vandenvalos objektus - būtinybė. Analizuojant skirtingus valdymo lygmenis - valstybės, regioninį bei vietinį - konstatuojama, kad ypač regioninis valdymo lygmuo yra pernelyg fragmentuotas. To priežastys - skirtingų valstybinių institucijų funkcijų persipynimas centriniame lygmenyje bei per tai atsirandančių izoliuotų regioninių institucijų tinklų egzistavimas. Analizė parodė regioninių valdymo struktūrų koordinavimo stoką, funkcijų dubliavimą, o tai ypač pastebima vandens stebėjimų srityje. Egzistuojančioje valdymo sistemoje vietinio lygmens institucijoms tenka vykdytojų funkcijos. Savivaldybėms ypač problemiška susidoroti su vandenvalos reikalavimais. Skatintinas savivaldybių kooperavimasis, tačiau jį riboja lėšų stoka. Sistemą papildomai komplikuoja keturių tarptautinių upių baseinų egzistavimas. Šį tarpvalstybinį upių baseinų valdymą apsunkina nevienodu tempu sudaromi bei realizuojami dvišaliai ir daugiašaliai susitarimai.
ENThe process of integration into the EU and Lithuania’s international environmental obligations had essential influence on the formation of water resources protection policies and entrenched the principles and the requirements to tune the corresponding legal acts with the norms, existing in the EU. The aim of the study is to evaluate the advantages and disadvantages, resulting from the changes in the water resource protection and management system and suggest the potential ways for resolution of the problems. The complication of the Lithuanian water resources protection and management system resulted from several development factors: the inherited inefficient environment protection system, non-correspondence of river catchments with the state borders, the fragmentary character of the requirements, provided by European legislation, different character of economic influence to the state of the water resources themselves and the necessity of large investments, especially into water cleaning objects. When analyzing different management levels – the state, regional and local, it can be stated that the regional management level is especially fragmented, due to the overlapping of functions of state institutions on the central level and the existence of isolated networks of regional institutions, which emerge due to the said reason. The analysis showed the lack of coordination of regional management structures and overlapping of functions, which is especially visible in the water monitoring area. The local level institutions in the existing management system perform the effectors’ functions. The municipalities find it especially problematic to cope with the water cleaning requirements. Cooperation between municipalities should be encouraged, however it is limited by the lack of funds.
