LTAsmens sveikatos priežiūros įstaigų žalos Privalomojo sveikatos draudimo fondo biudžetui nustatymo ir įrodinėjimo ginčuose tarp teritorinių ligonių kasų ir asmens sveikatos priežiūros įstaigų tema moksliniame lygmenyje nagrinėjama mažai. Dėl mišraus santykių tarp teritorinių ligonių kasų ir asmens sveikatos priežiūros įstaigų reglamentavimo, praktikoje ilgą laiką buvo neaiškus šių ginčų nagrinėjimo procesas. Straipsnyje, remiantis teisės aktų nuostatomis, išsamia teismų praktikos analize, siekiama išanalizuoti teritorinių ligonių kasų patikrinimo dokumentų teisinę reikšmę ir su ja susijusius civilinės atsakomybės kilimo sąlygų įrodinėjimo aspektus.
ENObject. The object of analysis here of is the legal value of final documents of control procedures, i. e. expert reports of the territorial health insurance funds and the aspects concerning the settlement of legal disputes; the latter aspects are determined in the legal acts and the case law of the Republic of Lithuania. Methodology. In order to achieve the goal, the essential features of relations between the territorial health insurance funds and personal health care institutions are distinguished, the legal value of inspection certificate of territorial health insurance funds in the legal acts of the Republic of Lithuania is analysed, and the systematic analysis of judicial practice in Lithuania is covered. The method of qualitative content analysis is used in the article. Conclusions. The relationship between the territorial health insurance funds and personal health care institutions implies the composite character. The final document of control procedure, i. e. an expert report accepted by the territorial health insurance funds is neither an administrative act nor an expert’s opinion. It is a statement of facts. Expert reports submitted to the courts by the territorial health insurance funds are judged on together with other evidence presented in the case. To be awarded an indemnification of CHIF budget, the territorial health insurance fund must address the court of general jurisdiction to prove the conditions of civil liability in accordance with the Civil Code of the Republic of Lithuania and the Code of Civil Procedure of the Republic of Lithuania. A personal health care institution which challenges civil liability conditions set out in the expert report has the right and duty to provide evidence including the findings of independent experts, to deny the non-existence of unlawful actions or actual damage to the CHIF budget.
