Summary / Abstract:

LTTyrimu siekiama identifikuoti ir išanalizuoti esamo teisinio reguliavimo ir baudžiamojo įstatymo, susijusio su neteisėtu disponavimu narkotinėmis ir psichotropinėmis medžiagomis, taikymo praktines problemas bei pateikti siūlymus dėl konkrečių teisės normų tobulinimo. Straipsnyje apžvelgiamos nusikalstamų veikų, susijusių su neteisėtu disponavimu narkotinėmis ar psichotropinėmis medžiagomis, dalyko ir jo kiekio nustatymo problemos teismų praktikoje – kaip pavyzdys pateikiamas narkotinių medžiagų pėdsakų teisinis įvertinimas. Tyrime daug dėmesio skiriama bausmių skyrimo už nedidelio kiekio narkotinių ar psichotropinių medžiagų kontrabandą teismų praktikos analizei. Taip pat straipsnyje analizuojama baudžiamoji atsakomybė už neteisėtą disponavimą narkotinėmis ar psichotropinėmis medžiagomis užsienio valstybėse. [Iš leidinio]

ENIn spite of researches made before in illegal disposal of narcotic and psychotropic substance, having in mind a huge number of criminal cases and the problems with it, also valuating the specificity field (lack of regulation) of Criminal Code of the Republic of Lithuania (Criminal Code), author submit this topic actual and necessity of new look. In this research the author identifies and analyzes the problems of current criminal law regulation, connected with illegal disposal of narcotic and psychotropic substance (Article 259-250 of Criminal Code), also problems with court practice and make suggestions about improving the regulation and court decisions. The next chapter assesses the problems in court practice of determining the quantity of the matter of crime, connected with illegal disposal of narcotic and psychotropic substance. Author gives an example – the trace of narcotic and psychotropic substance and assesses the possibility of criminal liability in this way.One of the main objects in the research is the punishments for small amount of smuggling of narcotic and psychotropic substance – there are overviewed large number of criminal cases. As a result of such an analysis, author make conclusion that courts almost in all cases imposes exclusively soft penalties for smuggling of small amount of narcotic and psychotropic substance. Such situation is not appropriate to current law regulation, because exclusively soft penalties are only exception, but not a rule. Courts turned in this way because of changed criminal law regulation. So author proposes specific amendments of this regulations, specially concerned with the smuggling of small amount of narcotic and psychotropic substance. The article also analyzes legal regulation and court decisions in the field illegal disposal of narcotic and psychotropic substance of foreign countries. Author notes that Lithuania, at the context of biggest part of Europe, is the one of the leader according imposed punishments for illegal disposal of narcotics and according punishments established in Criminal Code. Compering Lithuania to other Europe countries, we can notice that in Lithuania the possibility of judge freedom to choose alternative punishment (not imprisonment) is very limited. Finally, author gives some negative examples from the practice of law enforcement institutions and produces some amendments of Criminal Code, which should help to reduce such problems.
