Antroji scholastinė filosofija: tarpcivilizacinio dialogo paieška

LTŠiame straipsnyje nagrinėjama antrosios scholastikos (XVI–XVIII a.) tarptautinės teisės teorija, kuri buvo neatskiriama dalis teisės filosofijos, pasižymėjusios išsamumu ir analizės gilumu. Straipsnio autorius sutelkia dėmesį į pamatines kiekvienos tautos ir valstybės teises, pateiktas dominikonų vienuolio Francisco de Vitorios. Prieinama išvada, jog perkeltos į kultūrinę / civilizacinę erdvę, jos tampa pamatinėmis kultūrų ir civilizacijų teisėmis. Kadangi šios teisės reprezentuoja ir realizuoja nuostatą gerbti, saugoti ir puoselėti kultūras ir civilizacijas, jas galima taikyti kaip priemones palaikyti, užtikrinti ir skatinti tarpkultūrinę / tarpcivilizacinę komunikaciją bei dialogą.

ENThe article analyzes the international law theory of Second Scholasticism (16–18th c. AD ) contained within the legal philosophy that distinguished itself by completeness and depth of analysis. The author of the article concentrates on the fundamental rights of every nation and state presented by Dominican friar Francisco de Vitoria. The article comes to conclusion that, having been translated into the space of cultures and civilizations, those rights would turn into the fundamental liberties of every culture and civilization. Since the above-mentioned rights represent and implement the respectful, protective and fostering attitude to diverse civilizations and cultures, they could be used as tools for maintaining fostering and ensuring intercultural / intercivilizational communication and dialogue.
