LTLR Darbo Kodekso numatomais pakeitimais stengiamasi sureguliuoti darbo santykius, siekiant juos liberalizuoti, padaryti lankstesnius, kad jie atitiktų šių dienų Lietuvos rinkos ekonomines, investicines aktualijas bei atlieptų pačių darbuotojų ir darbdavių poreikius bei interesus. Straipsnyje nagrinėjamos galiojančio LR Darbo Kodekso bei LR Darbo Kodekso projekto nuostatos, reglamentuojančios darbo laiką. Taip pat apžvelgiami viršvalandžių, suminio darbo laiko bei ne viso darbo laiko aspektai, lyginant juos su ES įtvirtintu darbo laiko reglamentavimu. Straipsnyje analizuojamas LR Darbo Kodekso projekto nuostatų pokyčių poveikis darbo rinkos atstovams – darbuotojams ir darbdaviams, jų galimos pozicijos pasikeitimai darbo rinkoje.

ENThe article analyzes project provisions impact of the Labour Code of the Republic of Lithuania to the employees and employers, and their possible change in position on the labour market. The employment relationship requires changes, but society's attitude to future changes is often negative, especially in cases where the social partners can not find common agreement. Working time problem area here it is very difficult to find harmony between employees and employers. This article analyzes problematic issues that are related to the Labour Code project provisions regulatory aspects of working time (overtime, work on a part-time, summarry recording of working time, etc.) and its adaptation to the potential interest of the labour market participants. The main working methods: analysis of scientific literature and information sources, legislation analysis, comparison, systematization of data. First, this article analyzes the concept of working time and its types. In the current Labour Code – working time – it is time employee is required to work in the work assigned to him, and other equivalent periods. The Labour Code project design concept of working time a little bit different: “It is any time that the employee is at the employer's disposal and carries out duties under the employment contract”. The new concept introduces more legal clarity and helps to understand the terminology of the working time. Also the authors compare working time provisions of the regulation in the current Labour Code and the Labour Code project. They offer analysis of short-time work, part-time work, also summary recording working time, overtime, night work changes in the Labour Code project and the impact on the labor market participants.The new Labour Code gives greater liberalization of labour relations, e.g., it allows employee to individually negotiate overtime with their employer; finds more varied working time mode, abolish restrictions on the introduction of a total working time. Labour Code project provisions of working time regulation impact on employee and employers are difficult to assess, due to the different changes in the significance of weight. However, one thing is obvious that the current Labour Code of the Republic of Lithuania is already obsolete and the changes are vital for finding common social dialogue between labour market participants.
