Nemokumo reglamento naujovės

LTSėkminga įmonių veikla ir galimybė išsaugoti su nemokumu susiduriančias bendroves svarbi ne tik patiems ūkio subjektams, jų kreditoriams ir akcininkams, bet ir visai valstybių narių bei Europos Sąjungos (toliau – ES) ekonomikai, bendrajai rinkai bei investicijoms skatinti, normaliai bankų veiklai. Todėl teisės aktai, reguliuojantys nemokumo bylų sprendimą, turėtų leisti ne tik efektyviai paskirstyti nemokių bendrovių turtą, bet ir suteikti joms galimybę, kai įmanoma, išsaugoti ekonominę veiklą ir finansinį stabilumą. ES lygmeniu skiriama vis daugiau dėmesio procesinėms ir materialinėms teisės normoms, reguliuojančioms iš nemokumo kylančius santykius, suderinti. Vienas iš tokio proceso padarinių – 2017 metų vasarą įsigaliojusi naujoji Tarybos Reglamento (ES) Nr. 2015/848 dėl nemokumo bylų, OL L-141, 2015 (toliau – Nemokumo reglamentas) redakcija, pakeitusi dar 2000 metais priimtą reglamentą. ENIt took more than half a century for EU legislators to introduce the final version of Insolvency Regulation, which has not had any significant changes since it was implemented. It was more than obvious that adjustments were unavoidable. These discussions resulted in a revised version of Insolvency Regulation, which came into force on 26 June 2017. The new version is supposed to solve five main problems of the old version related to the scope of Regulation, determination of jurisdiction, supplementary proceedings, public register and insolvency of groups of companies. It could be agreed that new provisions opened the doors to many new types of insolvency proceedings, found a way to at least reduce the amount of forum shopping cases and built the much-needed framework for interconnecting insolvency registers. However, it is highly doubtful if the new version will manage to reduce the number of supplementary proceedings and if the method to coordinate the insolvency of groups of companies will be effective.
