Legal regulation of temporary agency employment in the European Union : from the beginning to modern interpretation

LTAtsižvelgiant į tai, kad laikinas darbas (darbo nuoma) užima vis didesnę darbo rinkos vietą, atsirado būtinybė teisės aktais sureguliuoti tokius užimtumo santykius. Šio teisinio reglamentavimo buvo siekta kompromiso keliu, bandoma suderinti priešingus darbo rinkos dalyvių - darbo naudotojų ir laikinųjų darbuotojų interesus. Siekiant minėto balanso, visų pirma, laikinas darbas turėjo būti įtvirtintas kaip viena iš žmogiškųjų išteklių valdymo opcijų, kita vertus, turėjo būti užtikrintos minimalios darbo, darbo užmokesčio garantijos, kurios užtikrintų ir garantuotų socialinę taiką. Šiame straipsnyje analizuojami laikinojo darbo teisinio reglamentavimo Europos Sąjungoje ypatumai. Autoriai apžvelgia laikinojo darbo įtvirtinimo teisines gaires nuo pačių pirmųjų teisėkūros iniciatyvų iki naujausių teisinių nuostatų. Straipsnyje remiamasi laikinojo darbo Europos Sąjungoje dinamikos principais ir tendencijomis, analizuojami atskirų valstybių teisinio reguliavimo ypatumai ir jų įtaka bendros Europos Sąjungos teisės nuostatoms. Pažymėtina, kad po ilgų ir ne visada sėkmingų bandymų pirmieji laikinojo darbo reglamentavimo aspektai buvo įtvirtinti Tarybos direktyvoje 91/383/EEB ir Tarybos direktyvoje 96/71/EB. Tuo tarpu specializuota Siems santykiams reguliuoti skirta direktyva buvo priimta lik 2008 metais. Ši direktyva įtvirtina darbo, darbo užmokesčio sąlygas laikiniesiems darbuotojams, įtvirtina nediskriminaviino principą. Straipsnio autoriai remdamiesi loginės analizės, sintezės, istoriniu lyginamuoju ir sisteminės analizės mokslinio tyrimo metodais analizuoja laikinojo darbo teisinio reglamentavimo Europos Sąjungoje evoliuciją. ENAlong with temporary employment occupying a part of the labour market, there emerges the necessity to regulate these employment relations. The regulation, however, has to be done under careful consideration and seek to balance the opposing interests of labour users and temporary workers. Achieving such a balance should establish temporary work as one of the options of effective human resource management, as well as ensure minimal work and remuneration standards guaranteeing social peace. This article analyses regulation of temporary agency work at the European Union level. The article reviews the development of processes determining temporary employment guidelines and the latest legal regulations at the European level. It analyses the dynamics of temporary employment regulations in the European Union, discussing the particularities determined by selected countries' legislation and collective agreements. After a long and unsuccessful search for a compromise in the European Union over the directive on temporary employment, partial regulation of temporary employment was provided for by the following directives: Council Directive 91/383/EEC and Council Directive 96/71/EC. A special directive on temporary employment was adopted as late as in 2008. It stipulates the working and pay conditions of temporary workers by establishing the principle of equal treatment as compared with workers who have a permanent contract of employment with a user undertaking. In this article, the author analyses the development of the legal regulation of temporary work in the European Union lawmaking and case-law by using logical analysis method, synthesis method, comparative historical method and the method of systematic analysis.
