ENIn this article the constitutional powers of the President of the Republic in the legislative process, while acting as a counterweight to the legislature are analyzed under the constitutional doctrine and primary sources: the right of legislative initiative, the promulgation of laws adopted by a referendum and the Seimas and the return of laws passed by the Seimas to the Seimas for reconsideration, as well as the appeal to the Constitutional Court as an influential mean on the legislative process. The article argues that today‘s realities presuppose the role of the head of state as an active participant in the politics and the legislative process, not as a passive observer. Consequently, constitutional powers of the President of the Republic in the legislative process are not honorary or symbolic duties of the head of state – in exercising this power the President acts as a real counterbalance to the legislature. The same applies not only to the right of the legislative initiative granted to the President of the Republic by the Constitution, which enables the head of state to execute his political agenda, but also to the use of the deferred (relative) veto right as an effective tool in the hands of the great publicly-held head of state. The article also reveals how actively and creatively the President of the Republic of Lithuania can initiate the process before the Constitutional Court and thus influence the various plans and initiatives of the members of the Seimas. The signing and official proclamation of laws is not just a symbolic act performed by the head of state.Therefore, the article analyzes some problematic aspects of the promulgation of laws – the term for signing a law, assurance of authenticity of the promulgation procedure of laws, legal consequences in the case of non-execution of the constitutional obligation of the President of the Republic to sign the adopted law or to return the law passed by the Seimas to the Seimas for reconsideration.
