Kodėl JAV netyrė "Lituanicos" katastrofos? Teisiniai ir politiniai aspektai "Darius & Girch" byloje

LTStraipsnyje nagrinėjama oficialioji Vašingtono pozicija ir vaidmuo garsiojoje „Lituanicos“ istorijoje. Tyrime remiamasi Jungtinių Amerikos Valstijų nacionalinio archyvo Valstybės departamento fonduose aptikta byla „Darius & Girch“ ir kitais dokumentais iš Lietuvos, Vokietijos ir JAV archyvų. S. Darius ir S. Girėnas buvo natūralizuoti JAV piliečiai ir per Atlantą skrido su JAV išduotais dokumentais, todėl lėktuvo katastrofą turėjo tirti būtent JAV. Atliktas tyrimas parodė, kad S. Dariaus ir S. Girėno žūties atveju oficialiojo Vašingtono reakcijos ir veiksmai patvirtina plačiai paplitusį požiūrį, kad tik po Antrojo pasaulinio karo įsitvirtino JAV nuostata pabrėžtinai rūpintis savo piliečiais, prireikus juos efektingai ginti visame pasaulyje, o iki tol instituciniu lygiu į kiekvieną atvejį buvo reaguojama lanksčiau, individualiau. Tyrime patvirtintos įžvalgos dėl Lietuvos ir JAV valstybių oficialių vaidmenų kaitos iškart po „Lituanicos“ katastrofos. 1933-1935 m. JAV vyriausybė peticijomis, rezoliucijomis bent keliolika kartų raginta, spausta imtis tyrimo, tačiau be rezultatų. Tokia JAV Valstybės departamento reakcija liudija, kad ketvirtajame dešimtmetyje JAV vyriausybė nepatiklių piliečių bruzdėjimus toleravo, bet iš esmės jų nepaisė. Po „Lituanicos“ katastrofos oficiali JAV pozicija suformuota maždaug per parą; tolesnės atomazgos Kaune stebėtos nesikišant; pozicijos laikytasi griežtai ir nuo sekliai, bent iki 1936 m. rugpjūčio. JAV „nesikišimas“ buvo formaliai paremtas skubia Lietuvos iniciatyva ir S. Dariaus, S. Girėno giminių sutikimu laidoti žuvusius lakūnus Kaune.

ENThe article analyses the official Washington's position and role in the famous history of "Lituanica". The research is based on the file "Darius & Girch", which was discovered in the National Archives and Records Administration and the funds of the State Department of the United States. S. Darius and S. Girėnas were naturalized citizens of the US and were flying through the Atlantic with documents issued by the United States, so the plane crash had to be investigated in the United States. The carried out investigation showed that the case of S. Darius and S. Girėnas death, the official Washington response and actions confirm the widespread view that only after the Second World War the US position to care for its citizens was firmly established to effectively protect them globally if necessary, and until then, on an institutional level, each case was responded more flexibly, more individually. The study confirms the insights on the change of official role of Lithuania and the United States immediately after the "Lituanica" catastrophe. In 1933-1935 the petitions and resolutions had brought about the US government at least a dozen times, pressed for an investigation, but without any results. The reaction of the US Department of State suggests that in the 1940s, the US government tolerated, but largely disregarded the mass disturbances of incredulous citizens. After the "Lituanica's" disaster, the official US position was formed in a day; further outcome in Kaunas was observed without interference; the position was held strictly and consistently, at least until August 1936. The "noninterference" was formally based on the urgent initiative of Lithuania's and S. Darius, S. Girėnas families' agreement to bury the dead pilots in Kaunas.
