LTŠiame straipsnyje nagrinėjamas teisinis paveldimo turto mokesčio reguliavimas Lietuvos Respublikoje ir šių mokesčių taikymo problemos. Taip pat analizuojamos paveldimo turto mokesčių apskaičiavimo procedūros, aptariama dokumentų, nurodančių paveldimo turto būklę, apmokestinamą jo vertę, mokesčio sumokėjimą, bei paveldėjimo teisės liudijimų išdavimo tvarka, nuolatiniams ir nenuolatiniams Lietuvos gyventojams paveldėjus turtą Lietuvos Respublikoje ar užsienyje. Straipsnyje įvertinama šio mokesčio reikšmė savivaldos biudžetui. Paveldimo turto mokestį reglamentuoja Lietuvos Respublikos paveldimo turto mokesčio įstatymas, kuris nuo 2003 m. numato ne tik Lietuvoje, bet ir užsienyje paveldimo turto apmokestinimą. Tai vietinis mokestis, apskaičiuojamas procentais nuo paveldimo turto apmokestinamosios vertės (5-10 proc.). Šis mokestis sudaro labai nedidelę savivaldybės biudžeto dalį. Lietuvoje šį mokestį apskaičiuoja paveldėjimo teisės liudijimus išduodantys Lietuvos Respublikos įstatymų įgalioti asmenys pagal jiems pateiktus paveldimo turto įvertinimo duomenis bei kitus dokumentus, kurių reikia nuosavybės teisei įforminti ir mokesčio lengvatoms pateisinti. Lietuvos gyventojas, paveldėjęs turtą užsienio valstybėse, privalo pats pateikti vietos mokesčio administratoriui mokesčio deklaraciją ir sumokėti mokestį. Nors teisinis paveldimo turto apmokestinimo reglamentavimas tobulinamas, neišspręstų klausimų dėl paveldėjimo objekto bei paveldimo turto mokesčio vis dar lieka.Reikšminiai žodžiai: Paveldėjimo mokesčiai; Mokesčiai nuosavybei; Nuosavybė; Inheritance taxes; Property taxes; Property; Patrimonial taxes.

ENThe article analyses the legal regulation of inheritance tax in the Republic of Lithuania and the problems in application of these taxes. It also analyses the procedures for calculation of inheritance taxes, discusses the procedure for issuing documents, which specify the state of inherited property, its taxable value, the payment of the tax, and Inheritance Certificates, when permanent and temporary residents of Lithuania inherit property in the Republic of Lithuania or abroad. The significance of this tax for the municipal budget is evaluated in the article. The inheritance tax is governed by the Inheritance Tax Law of the Republic of Lithuania, which stipulates the taxation of inherited property not only in Lithuania but also abroad from 2003. It is a local tax, calculated as a percentage from the taxable value of inherited property (5–10%). This tax makes up only a very small share of the municipal budget. In Lithuania, this tax is calculated by the persons authorised by laws of the Republic of Lithuania to issue inheritance certificates in accordance with the inherited property valuation data and other documents as submitted to them and required for execution of the right of ownership and justifying tax reliefs. A resident of Lithuania who inherited property in foreign states must himself submit to the local tax administrator a tax return and pay the tax. Although legal regulation of the taxation of inherited property is improved, a lot of issues with regard to the object of inheritance and the inheritance tax still remain unsolved.
