ENThis article is based on the author’s research titled “Enhancement of Human Rights Protection Using the Institute of Constitutional Complaint”. In this research the author answers the question what model of individual constitutional complaint would be the most appropriate for Lithuania. The aim of this article is to reveal the roots of the enhancement of constitutional complaint and its historical development and the impact on modern legal regulation of this institute in the world. An analysis of the antecedents of individual constitutional complaint and of modern legal reforms taken in the analysed countries of the world shows essential changes and changes of the lower importance on the material and procedural elements of the institute of constitutional complaint. The process of establishment of a constitutional complaint in the world allows deciding that the historical face of the predecessor of the constitutional complaint, i.e. particular actions of habeas corpus and amparo have transformed when states were sharing each other’s experience, as the extent of defended rights was constantly broadened, various remedies for the protection of human rights performing specific protection tasks, thus supplementing the general guarantee of judicial defence. For example, the origins of a constitutional complaint as a “coercive” judicial guarantee and the development of this instrument into a constitutional complaint as a constitutional right were disclosed in detail.The modern practice of the discussed countries influenced by predecessors of a constitutional complaint is followed by various national trends: establishment of an indirect protection of individual rights, the need to establish a comprehensive system of protection of fundamental rights by establishing a direct reference, and tightened requirements for direct reference, as an outcome of the application of the institute of a constitutional complaint. The author also concludes that, when a national model of an individual constitutional complaint is being formulated, it is advisable to take into account not only modern legal regulation of this human rights protection instrument but its historical enhancement, too. The cognition of the origins and later development of establishment of the institute of a constitutional complaint is important for broad and manifold perception of this institute. It could be helpful to support modern national reforms strengthening human rights protection instruments. [From the publication]
