Main constrains in implementing the EU asylum acquis in Lithuania

LT[...] Šio straipsnio tikslas – išnagrinėti pagrindines Lietuvos prieglobsčio teisės normas ES prieglobsčio teisyno požiūriu ir nustatyti problemas, kurios gali kilti įgyvendinant ES teisyno nuostatas. [...] Autorė pateikia pagrindinių ES teisės aktų, priimtų remiantis 1997 m. Amsterdamo sutarties 63 str., analizę. Šie teisės aktai atspindi pirmąjį ES prieglobsčio teisės derinimo etapą. [...] Toks derinimas privalomas tapus ES nare, nes šiuo metu jau veikia teisiniu požiūrius įpareigojantys ES prieglobsčio teisės aktai. Reikia pasakyti, kad prieglobsčio teisės derinimo procesas ES dar nėra baigtas, nes diskutuojama ir rengiamasi antrajam teisės derinimo etapui. Straipsnyje aptariami visi svarbiausi prieglobsčio teisės dokumentai, priimti pagal 1997 m. Amsterdamo sutarties 63 str.: 2001 m. direktyva dėl laikinosios apsaugos, 2003 m. Dublino reglamentas, 2003 m. priėmimo standartų direktyva, 2003 m. šeimos susijungimo direktyva, 2004 m. pabėgėlio sąvokos ir papildomos apsaugos direktyva bei 2005 m. prieglobsčio procedūrų direktyva. Iš probleminių šių dokumentų įgyvendinimo aspektų autorė išskiria teisės dirbti nesuteikimą prieglobsčio prašytojams prieglobsčio prašymo nagrinėjimo laikotarpiu, prieglobsčio prašytojų apgyvendinimo institucinę sistemą Užsieniečių registravimo centre, trumpus akivaizdžiai nepagrįstų prieglobsčio prašymų procedūros vykdymo terminus, [...], tinkamą socialinių garantijų neužtikrinimą prieglobstį gavusiems asmenims, pasibaigus socialinės integracijos laikotarpiui, nenuoseklų šeimos susijungimo teisės reglamentavimą LR teisės aktuose bei kitas problemas. EN[...] The aim of this article is to examine the fundamental norms of Lithuanian asylum law from an EU asylum law point of view and to establish the problems which can arise from implementing EU legal regulations. […] The author provides an analysis of the main EU legal acts adopted un support of the 1997 Treaty of Amsterdam, Article 63. These legal acts reflect the first stage of the negotiations for EU asylum law. […] This negotiation was required upon accession to the EU because at that time there was already a legal view in effect that obliged the adoption of acts of EU asylum law. It means the negotiations for the EU asylum law are not yet finished as discussions are in progress and preparations are underway for the second stage of the negotiations. The article discusses all the most important asylum law documents adopted in accordance with article 63 of the Treaty of Amsterdam: the 2001 directive on temporary protection, the 2003 Dublin Regulation, the standards directive adopted in 2003, the 2003 family reunion directive, the 2004 directive on asylum seekers and additional protection, and the 2005 asylum procedures directive. Out of the problems implementing these documents, the author isolates asylum seekers are not granted the right to work while their claims are being assessed, the asylum seekers’ accommodation at the Foreigners’ Registration Centre, the short period for assessment of the asylum seekers’ claims, […], appropriate social guarantees do not safeguard successful asylum seekers and when the social integration period ends, the inconsistent regulation of family reunion rights in the legal acts of Lithuania, and other problems.
