Valstybės politika darbuotojų saugos ir sveikatos srityje: efektyvumo problemos
LTDarbuotojų sauga ir sveikata - tai visos administravimo priemonės, skirtos darbuotojų darbingumui, sveikatai ir gyvybei darbe išsaugoti, kurios naudojamos ar planuojamos visuose įmonės veiklos etapuose, kad darbuotojai būtų apsaugoti nuo profesinės rizikos arba ji būtų kiek įmanoma-sumažinta. Šiame straipsnyje trumpai pateikiama institucijų, įstaigų ir organizacijų, formuojančių bei įgyvendinančių valstybės politiką darbuotojų saugos ir sveikatos srityje, funkcijų analizė, apibendrinamos veikiančios saugos ir sveikatos valdymo struktūrų sistemos respublikiniu, regioniniu bei įmonių mastu. Pateikiami bendrieji trišalio socialinių partnerių - valstybės, darbdavių bei profesinių sąjungų - bendradarbiavimo principai. Derinant Lietuvos teisės aktus su Europos Sąjungos teise, buvo atliekami naujų teisės aktų įgyvendinimo pasekmių tyrimai, kurių tikslas - surinkti ir susisteminti informaciją apie tikėtinas naujo teisės akto pasekmes, nustatyti kaštus ir naudą visam ūkiui ar visuomenei arba jų atskiroms grupėms, numatomos pasekmės įgyvendinus naują teisės aktą. Tyrimu nustatytos direktyvų įgyvendinimo teigiamos socialinės pasekmės - darbuotojų saugos ir sveikatos būklės įmonėse gerinimas, kuris turėtų sumažinti profesinių ligų ir nelaimingų atsitikimų darbe. Įgyvendinant valstybinę darbų saugos ir sveikatos programą toliau plėtojamas socialinių partnerių bendradarbiavimas darbuotojų saugos ir sveikatos srityje. Numatytos priemonės darbdaviams padės užtikrinti darbuotojų saugą ir sveikatą visais su darbu susijusiais aspektais, o darbuotojams sudarys palankesnes sąlygas naudotis LR Konstitucijos suteikta teise turėti saugias ir sveikas darbo sąlygas. Minėtos programos priemonių įgyvendinimas sudarys prielaidas visiškai realizuoti Lietuvos Respublikos įsipareigojimus Europos Sąjungai profesinės sveikatos ir saugos srityse.
ENSafety at work and health comprise all possible means of precaution and taking care of working - capacity, health and life. They are planned and used during all the stages of activity in an enterprise. Their aim is to protect the employees from all possible professional risks or to reduce them to as much as possible. This article presents the analysis of functions of different institutions, establishments and organizations which form and implement the state policy in the field of safety at work and health. Functioning systems of safety at work and health management structures at state, regional and separate company level are described in this work, too. General principles of three-party cooperation between the state, employers, and professional unions are presented either. While coordinating Lithuanian acts of legislation to the EU law, the analysis of the consequences of the new acts of legislation accomplishment was conducted. Its aim was to collect and to systemize the information about possible consequences of the new act of legislation, to detect the costs and benefits to the whole economy, to the society or to the separate groups of it in case the new act of legislation was implemented. The reseach work done allowed to detect the positive social consequences of the directives applied. They are as follows: improvement of safety and health conditions in enterprises, which in its turn is expected to reduce the number of professional illnesses and accidents at work.The cooperation between social partners is being further developed throughout the accomplishment of the safety at work and health programmes. The supposed means will help the employers to assure the safety and health to their employees in all the aspects related to the work. The employees will be provided with more favourable working conditions granted by the Constitution of the Republic of Lithuania. All of the above mentioned progammes will precondition the full accomplishment of the obligations of Lithuania to the EU in the field of safety and health.
