Lyties pakeitimo teisinių padarinių problematika

LTLietuvos Respublikos civilinis kodeksas nustato asmens teisę pakeisti lytį, tačiau įstatymų leidėjas vis dar vengia priimti įstatymą, kuriuo būtų numatyta lyties pakeitimo sąlygos ir tvarka. Todėl straipsnyje analizuojama lyties pakeitimo teisinių padarinių problematika šioje srityje. Europos Žmogaus Teisių Teismas, nepaisant ankstesniuose savo sprendimuose išsakytos nepalankios nuomonės transseksualams dėl civilinės būklės aktų registravimo, vėliau šią poziciją pakeitė, pripažindamas, kad valstybės privalo užtikrinti pakeistos asmens lyties pripažinimą. Lietuvos piliečiai, įgyvendinę teisę pakeisti lytį kitose šalyse, susiduria su aibe problemų keičiant civilinės būklės aktus. Problemų gali kilti guldant pacientą j ligoninę, skiriant vaistus, išduodant vizą, įgyvendinant teisę į pensiją ir kt. Tokiu būdu pažeidžiama asmens teisė į privatų gyvenimą. Kyla daug neaiškumų tokiose situacijose, kaip: asmens lyties pakeitimo fakto tikrumo fiksavimas, kitų šalių teisių bei teisėtų lūkesčių gynimas ir pan. Todėl, rengiant įstatymo, nustatančio lyties pakeitimo tvarką ir sąlygas, projektus, būtina atsižvelgti į straipsnyje iškeltas problemas.

ENCode of the Republic of Lithuania establishes the right of individuals to change sex, but the legislature still refuses to enact a law to provide for gender reassignment procedures and conditions. Therefore, in this article there is analysis of the gender reassignment for the legal consequences of the problems in this area. European Court of Human Rights in spite of previous decisions expressed an unfavorable opinion on transsexuals civil registration, but the latter decisions on this position was changed by states having a duty to ensure the recognition of a person's gender reassignment Lithuanian citizens by exercising the right to change the gender in other countries are facing a set of problems changing the civil status acts. Problems can arise when a patient is in hospital, seeks medication or travel visa, or in the implementation of the right to a pension, etc. Therefore the person's right to privacy is violated. There is a lot of uncertainty in such situations, as a person's gender being recorded correctly, or other third parties having rights and legal expectations, protection and so on. It is therefore necessary to take into account the issues raised by this article when passing law projects in the future to adjust the sex change procedure and conditions.
