Dovanojimo sutarties teisinis reglamentavimas Lietuvos Respublikoje
LTDovanojimo sutarties sudarymo sąlygos, forma, dovanotojo, apdovanotojo teisės ir pareigos ir šios sutarties nesilaikymo teisinės pasekmės reglamentuojamos Lietuvos Respublikos Civilinio kodekso šeštoje knygoje. Teisės sudaryti dovanojimo sutartį įtvirtinimas Lietuvos teisinėje sistemoje asmenims suteikė galimybę savo turtą laisva valia padovanoti kitiems asmenims. Siekiant užtikrinti dovanojimo skaidrumą ir išvengti piktnaudžiavimo šia teise, dovanojimo sutarties reglamentavimas papildomas naujomis sąlygomis, viena iš jų gyventojų pajamų mokesčio įstatyme įtvirtinta dovanojimo suma, kurią viršijus valstybei turi būti mokami mokesčiai. Šią dovanojimo sutarties sudarymo apribojimų įtvirtinimu mūsų valstybėje užtikrinama, kad sutarties šalys nepiktnaudžiautų Civilinio kodekso jiems suteiktomis teisėmis.

The donation agreement in the Republic of Lithuania is regulated by the Civil Code of the sixth book from 6.465 to 6.476 articles. This agreement is a unilateral and gratuitous. The parties - the donor and awarded. This agreement shall be established if a party fails to comply with the form of the donation agreement. It becomes invalid. The donor is entitled to cancel the agreement, if there is one of the condition for cancelling it. There are a lot of examples in Lithuanian law, when the donation agreement has been cancelled and the awarded have to pay everything on a way of restitution. The aim of this anicle is to analyse a legal regulation of the donation agreement in the Civil Code of the Republic of Lithuania In order to achieve this aim, were used descriptive and analytical of legislation and cases.
