Towards a new reform of Lithuanian consumer protection law

LTPirmasis vartotojų teisių apsaugos įstatymas buvo priimtas 1994 m., kuris iš principo neatitiko XX a. Europos valstybės standartų. Todėl vartotojų teisių apsaugos įstatymas pradėjo įgauti dabartinę formą tik pradėjus vykdyti civilinės teisės reformą 2000 m., kuri sutapo ir su pasiruošimu stoti į ES ir nacionalinės teisės derinimu su ES teisės aktais. Bendrijos reikalavimas "užtikrinti aukšto lygio vartotojų teisių apsaugą" tuo metu nebuvo Lietuvoje pilnai užtikrintas, nepakako vien tik perrašyti acquis communitaire į nacionalinę teisę. Straipsnyje pabrėžiama, kad siekiant užtikrinti vartotojų teisių įgyvendinimą, visų pirma, būtina užtikrinti, kad vartotojai žinotų savo kaip vartotojų teises ir kad jie lengvai galėtų gauti žalos atlyginimą. Taigi straipsnyje analizuojama kaip istoriškai kito vartotojų teisių apsaugos reguliavimas Lietuvoje ir kaip šie pokyčiai atsiliepė vartotojų teisių įgyvendinimui praktikoje, vartotojų teisių apsaugos reforma, nagrinėjamos vartotojų teisių apsaugos ir Civilinio kodekso nuostatos, Reglamentas dėl bendradarbiavimo vartotojų apsaugos srityje bei Direktyva dėl draudimų ginant vartotojų interesus perkėlimo į Lietuvos Respublikos teisinę sistemą (98/27/EB).Reikšminiai žodžiai: Vartotojų apsaugos teisė; Consumer protection law.

ENThe first law on protection of consumer rights was adopted in 1994. The law in principle failed to correspond to the standards, applicable in European countries in the 20th century. The law commenced to be shaped into its present form only upon the beginning of the implementation of the reform of the civil law in 2000, which coincided with the preparation for accession into the EU and the tuning of the national legislation with the EU legal acts. The Community’s requirement "to ensure a high level of protection of consumer rights" was not fully ensured in Lithuania at the moment, it was not enough to just rewrite the acquis communitaire into the national legislation. The article stresses that in order to ensure the implementation of consumer rights, first of all, it is necessary to ensure that the consumers are aware of their rights and are able to receive the indemnification of a loss and damage in a simple manner. Therefore the article analyzes the ways the regulation of protection of consumer rights changed historically in Lithuania and how the changes were reflected in the implementation of the consumer rights in practice, the reform of protection of consumer rights, the provisions on protection of consumer rights and the Civil Code, the Regulation on cooperation in the area of consumer rights protection and the transposition of the Directive on injunctions for the protection of consumers’ interests (98/27/EC) into the Legislation of the Republic of Lithuania.
