Реформа судебной власти в Литовской Реслублике : основные результаты и перспективы

LTStraipsnyje nagrinėjama teismų valdžios reforma Lietuvos Respublikoje: aptariami teisės aktai, reglamentuojantys teismų valdžios veiklą, išskiriami svarbiausi reformos aspektai – institucinė reformos pusė, reforma, kuria siekiama sustiprinti teismų nepriklausomumą, atkreipiamas dėmesys į prokuratūros ir teismų tarpusavio santykius. Straipsnyje kalbama apie bendrosios kompetencijos ir specializuotus teismus, išskyrus Konstitucinį teismą, kadangi šis teismas turėjo didelės įtakos teismų reformai, bet joje nedalyvavo. Teismų sistemos reforma Lietuvoje tęsėsi pakankamai ilgai, per penkiolika metų buvo priimtos trys teismų įstatymo redakcijos, taip pat Konstitucinis teismas priėmė tris nutarimus dėl teismų nepriklausomumo. Kalbant apie teismų reformą Lietuvoje, ji vystoma tinkama linkme, stiprinant teismų valdžios nepriklausomumą. Visgi pažymėtina, kad nepakankamai efektyviai sprendžiama teisminės ir vykdomosios valdžių santykio problema. Tokios problemos sprendimo pavyzdys yra teisingumo ministerijos ir teismų tarybos bendradarbiavimas.Reikšminiai žodžiai: Teisės reforma.

ENThe article deals with the reform of the power of courts in the Republic of Lithuania by discussing legislation that regulates the activities of the power of courts, distinguishing the main aspects of the reform – its institutional side, the reform aimed at strengthening the independence of courts, drawing attention to the mutual relationship of the prosecutor’s office and courts. The article addresses courts of general competence and speciality courts other than the Constitutional Court. The court system reform went on for quite some time in Lithuania, three wordings of the court law were adopted over fifteen years and the Constitutional Court passed three decisions on the independence of courts. Speaking of the court reform in Lithuania, it is being developed in the right direction by strengthening the independence of the court power. It still has to be admitted that the issue of the relationship between the court and the executive power is being handled inefficiently.
