Legal issues on the continuity of the Republic of Lithuania

LTStraipsnis parašytas 15-ųjų Lietuvos Respublikos nepriklausomybės atkūrimo metinių proga ir yra skirtas šiuolaikinės Lietuvos valstybės tarptautinio teisinio statuso ypatumams, susijusiems su jos nepriklausomybės atkūrimo 1990 m. kovo 11 d. teisiniais pagrindais. Pagrindiniai straipsnyje analizuojami klausimai yra du: 1) ar pagal tarptautinę teisę Lietuvos Respublikos teritorija buvo teisėta SSRS dalis; 2) ar atkūrusi nepriklausomybę Lietuvos Respublika yra tarptautinės teisės požiūriu identiška tarpukario Lietuvos Respublikai (Lietuvos valstybės tęstinumas ir identitetas). Analizuojant šiuos klausimus, straipsnyje taip pat teisiškai įvertinami Molotovo - Ribentropo pakto slaptieji protokolai (įrodomas jų niekinis pobūdis), 1940 m. SSRS veiksmai prieš LR kvalifikuojami kaip agresija ir argumentuotai paneigiami šiuolaikinės Rusijos teiginiai apie tariamą teisėtą Baltijos valstybių prijungimą prie Sovietų Sąjungos, apibrėžiamas Lietuvos Respublikos teisinis statusas 1940 - 1990 m. (parodomas jos tęstinumas), atskleidžiami Lietuvos Respublikos nepriklausomybės atkūrimo 1990 m. teisiniai pagrindai, argumentuotai paaiškinama, kodėl pagal tarptautinę teisę 1991 m. suteiktas tarptautinis pripažinimas buvo ne Lietuvos valstybės, o jos naujos vyriausybės pripažinimas, kodėl LR nėra SSRS teisių perėmėja, taip pat trumpai apibūdinamas dar neišspręstas Rusijos atsakomybės už sovietinę Lietuvos okupaciją klausimas. Straipsnis padeda suvokti Baltijos valstybių tęstinumo ir jų nepriklausomybės atkūrimo unikalumą tarptautinės teisės bei tarptautinių santykių istorijoje. ENThe article was written on the occasion of the 15th anniversary of regaining of independence of the Republic of Lithuania and is dedicated to the traits of international legal status of the modern state of Lithuania, relating to the legal grounds for regaining of independence on 11 March, 1990. The main issues, analyzed in the article, are the following two: 1) whether the territory of the Republic of Lithuania was a legitimate part of the USSR according to the international law; 2) whether, upon regaining of its independence the Republic of Lithuania is identical to that of the inter-war period in terms of the international law (succession and identity of the state of Lithuania). When analyzing the said issues the article also provides a legal identification of the secret protocols of the Molotov – Ribbentrop pact (their null character is evidenced), qualifies the actions, taken by the USSR against the Republic of Lithuania in 1940 as aggression and denies modern Russia’s statements on the alleged legitimate annexation of the Baltic States to the Soviet Union, defines the legal status of the Republic of Lithuania in 1940 - 1990 (its succession is evidenced), reveals the legal basis for regaining of independence of the Republic of Lithuania in 1990, explains why the international recognition, provided in 1991 according to the international law was the recognition of the new government of Lithuania, but not the state of Lithuania itself, why the Republic of Lithuania is not a successor to the rights of the USSR and also provides a brief characterization of the issue of Russia’s responsibility for the Soviet occupation of Lithuania, which has still not been resolved. The article helps to comprehend the uniqueness of succession of the Baltic States and reinstatement of their independence in the history of international relations and international law.
