Summary / Abstract:

LTKonstitucijos viršenybės principas yra plačiai Lietuvos teisės doktrinoje sutinkamas principas. Konstitucinės teisės specialistai šį principą priskiria prie esminių koordinacinių Konstitucijos tikslingumo ir teisinės valstybės principų. Šio principo interpretacija yra plačiai pateikta itin aktualioje Konstitucinio Teismo praktikoje. Tyrimo autoriai, analizuodami keletą itin reikšmingų 1999 - 2004 metų laikotarpio Konstitucinio Teismo nutarimų, atskleidžia pagrindinius šio principo aspektus. Didžiausias dėmesys skiriamas 2004 m. gegužės 25 d. Konstitucinio Teismo nutarimui byloje, kurioje buvo nagrinėjamas Prezidento priesaikos esmės ir reikšmės klausimas. Pirma, Konstitucija, kaip aukščiausią teisinę galią turintis teisės aktas, išreiškia bendrą visuomenės susitarimą. Remiantis Konstitucija turi būti kuriama visa Lietuvos teisinė sistema, todėl Konstitucijoje nėra ir negali būti reguliavimo spragų. Antra, Konstitucija negali būti aiškinama vien tik remiantis lingvistine interpretacija. Konstitucijos dvasia reikalauja visą jos tekstą vertinti kaip vientisą, tarpusavyje susijusių principų sistemą. Atitinkamai, valstybės pareigūno duodama priesaika negali būti laikoma tik formaliu simboliniu aktu. Priesaikos esmė yra jos konstitucinė prigimtis ir sukeliamos konstitucinės pasekmės. Konstitucijos viršenybės principas suponuoja tai, kad Konstitucijos nuostatos negali būti aiškinamos jas grindžiant kitais įstatymais ar poįstatyminiais teisės aktais. ENThe principle of the supremacy of the Constitution is widely embedded in the legal doctrine of Lithuania. Specialists of constitutional law attribute this principle to major coordination principles of Constitution expediency and of the state of law. Integration of this principle is broadly covered in the practice of the Constitutional Court, which is of particular relevance. The authors of the research reveal the main aspects of this principle, when analysing several particularly significant rulings of the Constitutional Court of the period 1999–2004. The major focus is given to the ruling of the Constitutional Court of 25 May 2004 in the case, where the issue of the essence and significance of the presidential oath was looked into. Firstly, the Constitution as the legal act of the highest legal power expresses a common agreement of the society. The legal system of Lithuania must be based on the Constitution, no regulation loopholes therefore should and can be present in the Constitution. Secondly, the Constitution cannot be interpreted only linguistically. The spirit of the Constitution requires to consider its text as a single system of interrelated principles. Accordingly an oath given by a public servant cannot be considered only a formal symbolic act. The core of the oath is its constitutional nature and constitutional consequences caused. The principle of the Constitution’s supremacy presupposes that the Constitution’s provisions cannot be interpreted based on other laws or supporting legislation. The authors’ position is based on the fact that the Constitution’s meaning lies within the Constitution itself.
