Summary / Abstract:

LT[...] Apibendrinant nacionalinių teismų ir Europos Žmogaus Teisingumo jurisdikcijos bei jurisprudencijos sąlyčio klausimus reikia pasakyti, kad šių institucijų bendradarbiavimas gali praversti įvairiems tikslams: vienas jų galėtų būti bylų krūvio paskirstymas, antras – nacionalinių teismų ir tarptautinių teismų sprendimų kokybės pagerinimas Veiksmingas Europos ir nacionalinių teismų, ypač aukščiausiųjų ir konstitucinių teismų, bendradarbiavimas yra būtinas žmogaus teisių apsaugos sistemai, nustatytai Europos žmogaus teisių konvencijoje, sėkmingai įgyvendinti. Pažymėtina, kad tarptautinė žmogaus teisių apsaugos sistema negali būti veiksminga, jei Konvencijoje nustatytos teisės ir laisvės, visų pirma, nebus užtikrintos nacionaliniu lygiu. Kalbant apie nacionalinių teismų santykį su Europos Teisingumo Teismu, reikia pažymėti, jog Europos valstybių konstitucinė jurisprudencija vis dėlto patvirtina, kad būtent valstybių narių konstitucijos yra valstybių narių bendradarbiavimo Europos integracijos procese pagrindas, tačiau nustato, kad Bendrijos pirminė ir antrinė teisė taip pat įpareigoja valstybes. Vis dėlto plėsdamasi Europa negali apseiti nei be Teisingumo Teismo jurisprudencijos, nei be valstybių narių konstitucinių teismų.[...] Taigi tarp Europos tarptautinių ir valstybių narių teismų kuriasi ne hierarchinė, o galių pusiausvyros sistema. Konstitucinis teismas negali pretenduoti į viršenybę prieš Europos Teisingumo Teismą, naudodamasis, kad valstybėje narėje taikant Europos teisę tarsi galutiniu kriterijumi tampa konstitucinė teisė. EN[...] In summary of the matters of the relationship between the jurisdiction and jurisprudence of national courts and the European courts it has to be said that the cooperation of these institutions can serve different ends one of them being distribution of load, another – improvement of the quality of decisions of national and international courts. Efficient cooperation of European and national courts is necessary for the successful implementation of the human rights protection system as established under the European Convention on Human Rights. It ought to be noted that the international human rights protection system cannot be efficient if the rights and freedoms under the Convention are not ensured at a national level. Speaking about the relationship between national courts and the European Court of Justice, it must be said that the constitutional jurisprudence of the Member States endorses that the cooperation among Member States in the process of integration is based on national constitutions, yet provides that the primary and secondary law of the Community is also binding on the states. Still, with Europe growing larger, it cannot do without the jurisprudence of the Court of Justice nor the constitutional courts of the Member States.[...] So, a system of balance of power rather that of hierarchy is being created between European international and Member States’ courts. The constitutional court cannot aim to be superior over the European Court of Justice on account that constitutional law becomes some sort of the final criterion in the Member State that applies the European law.
