Prekių ženklo savininko išimtinių teisių ir jų ribojimų aiškinimas Europos Teisingumo Teismo praktikoje

LTSiekiant užtikrinti prekių ženklų teisinės apsaugos Bendrijoje vienodumą ir jos efektyvumą, buvo priimti teisės aktai: 1988 m. gruodžio 21 d. Pirmoji Tarybos direktyva (EEB) Nr. 89I104 dėl valstybių narių prekių ženklų įstatymų derinimo (toliau - Direktyva) ir 1993 m. gruodžio 20 d. Tarybos reglamentas (EB) Nr. 40194 dėl Bendrijos prekių ženklo (toliau - Reglamentas). Greta kitų prekių ženklų teisės klausimų jais buvo suvienodintas ir išimtinių prekių ženklo savininko teisių turinys: Direktyvos 5 straipsnio 1 dalyje ir 2 dalyje, Reglamento 9 straipsnio 1 dalyje buvo apibrėžtos (iš esmės analogiškai) išimtinės prekių ženklo savininko teisės, o Direktyvos 6 straipsnyje ir 7 straipsnyje bei Reglamento 9 straipsnyje, 12 straipsnyje bei 13 straipsnyje buvo nurodyti galimi šių teisią ribojimai. Lietuvai stojant į Europos Sąjungą šios taisyklės buvo perkeltos į nacionalinę teisę: 2000 m. spalio 10 d. Lietuvos Respublikos prekių ženklų įstatymo1 38 straipsnio 1 dalimi buvo įgyvendintos Direktyvos 5 straipsnio 1 dalies ir 2 dalies nuostatos dėl išimtinių prekių ženklo savininko teisių; 39 straipsniu ir 40 straipsniu buvo įgyvendinti Direktyvos б straipsnyje ir 7 straipsnyje numatyti šių teisių apribojimai. Nuo 2004 m. gegužės 1 d. Lietuvoje tiesioginio taikymo galią įgijo Reglamentas. Tačiau naujų teisės normų atsiradimas dar neleidžia teigti esant Lietuvos prekių ženklų teisės atitiktį Bendrijos teisei. Ne mažiau svarbu yra tinkamai ir nuosekliai jas aiškinti ir taikyti. Vienodą Direktyvos ir Reglamento aiškinimo ir taikymo valstybėse narėse praktiką padeda užtikrinti Europos Teisingumo Teismo teikiami jų normų išaiškinimai.Reikšminiai žodžiai: Trademark Law.

ENIn order to ensure the uniformity and efficiency of legal protection of trademarks in the Community, the following legal acts were adopted: the First Council Directive (EEC) No. 891104 of 21 December 1988 to Approximate the Laws of the Member States Relating to Trade Marks (hereinafter referred to as the Directive) and Council Regulation (EC) No. 40194 of 20 December 1993 on the Community Trade Mark (hereinafter referred to as the Regulation). Apart from other issues, pertaining to trade marks, the said documents also uniformed the content of exclusive rights of an owner of a trade mark: the exclusive rights of an owner of a trade mark were defined in Part 1 and Part 2 of Article 5 of the Directive and in Part 1 of Article 9 of the Regulation (in essence analogically) and the possible limitations of the rights were stated in Article 6 and Article 7 of the Directive and in Article 9, Article 12 and Article 13 of the Regulation. When Lithuania was accessing the European Union the regulations were transposed into the national legislation: the provisions regarding the exclusive rights of an owner of a trade mark, contained in Part 1 and Part 2 of Article 5 of the Directive were implemented in Part 1 of Article 38 of the Law on Trade Marks of the Republic of Lithuania of 10 October 2000; Article 39 and Article 40 of the said law implemented the limitations of the rights, foreseen in Article 6 and Article 7 of the Directive. Starting from 1 May 2004 the Regulation acquired the power of direct application in Lithuania. However the emergence of new legal norms does not allow for stating that Lithuanian legislation, pertaining to trade marks, corresponds to that of the Community. Another important thing is appropriate and consistent application and interpretation of the provisions.Explanations of the norms of the Directive and the Regulation, provided by the European Court of Justice, help to ensure a uniform practice of their application and interpretation in the Member States.
