Konstitucinė darbuotojų teisė streikuoti: šios teisės įgyvendinimo teisinės prielaidos ir sąlygos

LTDetalus įstatyminis darbo santykių reguliavimas nesudaro tinkamų ir optimalių sąlygų rinkos vystymuisi ir, dar daugiau, neužtikrina absoliučių darbo bei socialinių garantijų darbuotojams. Tai paskatino vystyti kolektyvinius darbo santykius, suteikiant kuo daugiau galimybių darbuotojams ir darbdaviams bei jų organizacijoms aktualius darbo ir su jais susijusius socialinius bei ekonominius klausimus spręsti tarpusavio derybomis. Tačiau pavienio darbuotojo, neginčijamai silpnesnės darbo santykių šalies, galimybės paveikti darbdavį yra minimalios. [...] Todėl darbo santykių srityje imtasi skatinti kolektyvinius darbuotojų ir darbdavių santykius, kurie apima profsąjungų ir darbuotojų organizacijų veiklą, kolektyvines derybas, kolektyvinių sutarčių pasirašymą bei streikų ir lokautų teisę. Šio proceso įtakoje susiformavo bendrasis požiūris, kad darbo santykiai savo esme yra kolektyviniai santykiai, o šio požiūrio pagrindas - kolektyvinės darbo santykių šalių autonomijos principas ir asociacijų teisių bei su tuo susijusių santykių pripažinimas, kur svarbią vietą užima ir teisė streikuoti. Darbuotojų teisę streikuoti garantuoja LR Konstitucijos 51 straipsnis, kuriame teigiama, kad darbuotojai, gindami savo ekonominius ir socialinius interesus, turi teisę streikuoti, o šios teisės apribojimus, įgyvendinimo sąlygas ir tvarką nustato įstatymas. Šiuo įstatymu šiandien yra LR Darbo kodeksas, kurio 76 - 85 straipsniai kaip tik ir yra skirti teisės streikuoti, streiko skelbimo, vadovavimo streikui, streiko teisėtumo klausimams reglamentuoti. ENA detailed legal regulation of labour relations does not ensure appropriate and optimum conditions for development of the market and the absolute labour and social guarantees for employees, which encouraged the development of collective labour relations, providing employers, employees and their organizations the largest amount of possibilities to resolve the relevant issues of labour and the related social and economic issues by mutual negotiations. However the possibilities to influence the employer, held by the individual employee, who is undoubtedly the weaker party of the labour relations, are minimal. [...] Therefore in the area of labour relations actions were taken in order to encourage collective relations between employers and employees, covering the activities of trade unions and employees’ organizations, collective negotiations, conclusion of collective agreements and the right to strikes and lockouts. Under the influence of the process there emerged the common view that labour relations are collective relations and the basis for such a view is the principle of collective autonomy of the parties to the labour relations and recognition of the rights of associations and the related relations, where the right to strikes takes an important position. Employees’ right to strike is guaranteed by Article 51 of the Constitution of the Republic of Lithuania, which states that employees, while defending their economic and social interests, shall have the right to strike and the limitations of this right and the conditions and procedure for its implementation shall be established by the law. At present the said law is the Labour Code of the Republic of Lithuania, articles 76 – 85 of which regulate the issues of the right to strike, declaration of a strike, the body, leading a strike and lawfulness of a strike.
