Jurisdikcijų konfliktai ir jų sprendimo būdai civilinėse bylose

LTStraipsnyje analizuojamos tarptautinio civilinio proceso problemos. Daugiausia dėmesio skiriama kompetencijai bylose, kai yra užsienio elementas. Darbo tikslas yra palyginti Europos Sąjungos reglamentą Nr. 44/2001 dėl teismų kompetencijos ir sprendimų pripažinimo civilinėse ir komercinėse bylose ir Lietuvos Respublikos civilinio proceso kodekso nuostatas, reglamentuojančias tarptautinio teismingumo klausimus, įžvelgti skirtumus bei nustatyti situacijas, kada susidaro jurisdikcijų konfliktai. Straipsnyje siūloma, kaip būtų galima išvengti juridikcijų konfliktų, suderinus mūsų šalies teisės aktus su Europos Sąjungos reglamento nuostatomis.

ENLithuania having plans to join European Union has pledged to harmonize its legislation with the provisions of European legal acts. Author analyzes whether the provisions of Lithuanian Code for the Civil Procedure is harmonizes with the provisions of EC Regulation (EC) No. 44/2001 On Jurisdiction and Foreign Judgements in Civil and Commercial Matters. Authors finds differences because of witch conflicts of jurisdiction could arise. Main difference is discovered in regulation of general competence of the courts to hear cases with foreign clement. The Lithuanian Code for the Civil Procedure allow to exercise the jurisdiction to foreign defendant if he was served with the service of process while his temporal stay in Lithuania or defendant has property in Lithuania in despite of that his temporal stay or property in Lithuania is not connected to the dispute. This is exorbitant jurisdiction and similar provision arc not found in EC Regulation. Author recommends to conform Lithuanian rules for jurisdiction with the provision of EC Regulation in order to avoid conflicts of jurisdiction.
