Summary / Abstract:

LTStraipsnis skiriamas Lietuvos ir Šveicarijos teisės aktų, reglamentuojančių arbitražo klausimus (konkrečiai sporto ginčų arbitruotinumą ir arbitražines išlygas), bei Tarptautinio sporto arbitražo kodekso atitinkamų nuostatų sisteminei analizei. Būtent toks temos nagrinėjimo aspektas pasirinktas, siekiant ištirti, kokių ginčų sprendimą įtvirtina Tarptautinio sporto arbitražo kodeksas, ir ar tokių ginčų sprendimą leidžia Šveicarijos (kur vyksta arbitražo procesas) bei Lietuvos (kur Lietuvos sportininkų ir/ar sporto organizacijų ginčo atveju toks sprendimas turėtų būti pripažįstamas ir vykdomas) teisė. Tik išsiaiškinus sporto ginčų sampratą ir jų sprendimo Tarptautiniame sporto arbitraže sąlygas, bus galimas ir pats ginčų sprendimas. [Iš leidinio]

ENConditions of sport disputes resolution in the Court of Arbitration for Sport (CAS) are analyzed in this article. One of these conditions is arbitrability, and another one - arbitration agreement. Under the Code of the CAS any dispute related or connected to sport can be solved in the CAS. While Switzerland's Federal Code on Private International Law states that all pecuniary claims may be submitted to arbitration. According to the explanation of Switzerland Supreme Court this provision means that all disputes where a professional sportsman is involved have pecuniary meaning, so they can be solved in the CAS. While in Lithuania there was a dispute whether sport contracts is civil or labor contract, where the disputes that arise from the labor contract cannot be solved in arbitration under the regulation of the Law of the Commercial Arbitration of the Republic of Lithuania. But at that moment seems that the legislature and courts sport contracts treat as a civil contract. It is required that arbitration agreement could be manifestly expressed. Such regulation is because of serious efTects of arbitration agreement that means the parties refuse the jurisdiction of courts. So under the regulation of Switzerland's Federal Code on Private International Law arbitration agreement may be in writing. At the beginning of this article sport disputes are analyzed for better understanding of this topic. [From the publication]
