Economic aspects of the bankruptcy law
LTStraipsnyje nagrinėjama įmonių bankroto procedūra ekonominiu požiūriu. Lyginamas ekonominis privataus kreditoriaus interesų gynimo ir įmonių bankroto procedūros efektyvumas susidarius įmonės nemokumo situacijai. Remiantis įmonės nemokumo socialiniais ir privačiais kaštais analizuojama, ar jie skiriasi taikant privatų kreditoriaus interesų gynimą ir bankroto procedūrą. Straipsnyje remiamasi teiginiu, kad įmonių bankroto procedūra reikalinga tik tuo atveju, jei ji labiau nei privatus kreditoriaus interesų gynimas gali sumažinti įmonės nemokumo kaštus. Atskleidžiama, kaip įmonių bankroto procedūra sumažina šiuos kaštus ir kokie turėtų būti veiksmingos įmonių bankroto procedūros tikslai.
ENThe article analyses the procedure of enterprise bankruptcy from economic point of view. The economic efficiency of defence of interests of a private creditor and the procedure of enterprise bankruptcy is analysed. Based on social and private costs of an enterprise’s insolvency, the article analyses whether they differ when applying the defence of creditor’s private interests and the bankruptcy procedure. The article is based on the statement that the procedure of enterprise bankruptcy is necessary only when it can decrease enterprise insolvency costs more that the protection of creditor’s private interests. The article reveals the way enterprises’ bankruptcy procedure decreases these costs and which should be the goals of the efficient enterprises’ bankruptcy procedure.
