Summary / Abstract:

LTNaujuoju Civiliniu kodeksu vykdant nacionalinės civilinės teisės reformą buvo perimama kelių valstybių teisė, o tai neigiamai paveikė civilinės teisės sistemiškumą. Minėta problema pastebima ir nagrinėjant ilgalaikės nuomos bei prievolinės nuomos institutus. Šiame straipsnyje nagrinėjami ilgalaikės nuomos ir prievolinės nuomos esminiai bruožai, atskyrimo kriterijai ir iš to kylantys teisiniai padariniai bei pateikiama teisinio reglamentavimo tobulinimo rekomendacijų. ENOver ten years has passed since the new Civil Code of the Republic of Lithuania introduced the number of legal novelties, inter alia, right in rem – emphyteusis. However, the analysis of the case law reveals that legal disputes based on this right do not reach courts for the settlement. Such situation exists due to the lack of the legal certainty and restrictive interpretation of legal relations concerning lease. The main criteria of the distinction between emphyteusis and contractual lease proposed in the case law and by scholars are not sufficient. Thus, the article proposes criterion of the balance of rights and duties of the parties. The article inter alia discuses problems arising from the lease of the state land occupied by third party owned buildings as well as the possibility to apply mandatory provisions of the contractual lease for emphyteusis, especially in case of emphyteusis of apartment.
