ENThe article deals with the works of the Lithuanian emigration (post-WWII) authors - M. Biržiška, Ve. Biržiška, В Masiulis, P. Stravinskas et al., in which the role of the legal profession in carrying into effect and defending the right of the nation to use its native tongue in public life during the course of different historical periods is considered. During the period of the ban on the Lithuanian press in Latin characters (1864-1904), an exceptional role of the legal profession was played in cases concerning the Lithuanian press which were brought before the Senate, the Supreme Court of imperial Russia, in which they succeeded in proving that the ban of the Lithuanian press in Latin characters was illegal, thus contributing to the abolishment of the ban on the press. Upon recovery of the press, 1905-1915 the lawyers together whith the other scanty groups of Lithuanian intelligentsia, were concerned in about teaching the Lithuanian language in schools, wrote for the newspapers, set up and led cultural societies, held meetings and other arrangements which expanded the sphere of the Lithuanian language and made its way into public life easier.In the independent state of Lithuania (1918-1940), the Lithuanian language became, for the first time in history, the state language used officially in the governmental institutions of the country which brought to the fore the problem of legal terms indespensable for draffing laws, governing, court procedure, legal literature and other related fieds. In the works of the legal profession of the emigration, scientific articles and the reminiscences, the process of developing legal terms , the role of the Ministry of Justice, the State Council in the process, positive features and shortcomings of Lithuanian legal terms and their causes, as well as the names of the Lithuanian “term pioneers” or the so-called “term-coiners”, have been first revealed.
