Vekselis - teisinis reguliavimas Lietuvos Respublikoje

LTVekselis - populiari atsiskaitymų priemonė, plačiai naudojama tarptautiniuose verslo santykiuose. Lietuvai plėtojant tarptautinę prekybą, konkrečios mokėjimo priemonės teisinis vertinimas yra labai svarbus. Straipsnyje „Vekselis - teisinis reguliavimas Lietuvos Respublikoje“ nagrinėjami įsakomųjų ir paprastųjų vekselių mokėjimo teisinių aspektų principai, vekselių teisės fundamentinės teorijos. Lietuvos Respublikoje vekselių mokėjimą reguliuoja Lietuvos Respublikos įsakomųjų ir paprastųjų vekselių įstatymas, priimtas 1999 m. Dauguma valstybių remiasi unifikuota vekselių teise, grindžiama pagrindiniu tarptautinės vekselių teisės aktu –1930 m. Ženevos vekselių konvencijoje patvirtintas Bendrasis įstatymas dėl įsakomojo ir paprastojo vekselio. LR įsakomųjų ir paprastųjų vekselių įstatymas kurtas, remiantis Konvencijos pagrindinėmis nuostatomis. Vadinamoji vekselių teisės sistema apima visas valstybes, prisijungusias prie šios Konvencijos. Lietuvos Respublika prisijungė 1938 m. Ženevos vekselių teisė yra lyginama su anglosaksų teisės sistema, siekiant atskleisti abiejų sistemų pagrindinius skirtumus ir panašumus. ENBill of exchange is one of the most relevant forms of payment widely used in international business relations. Due to the present situation of Lithuania in developing the international trade, the legal assessment of given form of payment is very important. The article "Bill of exchange and promissory note - the legal regulation in the Republic of Lithuania" analyses principle legal aspects of payment by bills of exchange and promissory notes, as well as the fundamental theories of bill of exchange and promissory note law. The payment by bills of exchange and promissory notes in the Republic of Lithuania is regulating by the Act of bills of exchange and promissory notes, which was adopted in 1999. Likewise in the most modern countries regulation of this form of payment in Lithuania is based on principal provisions which were adopted in Geneva Convention on Unanimous law of bill of exchange and promissory notes in 1930. The Act of bill of exchanges and promissory notes was created in accordance with principle notes of the given Convention. So-called law system of bills of exchange and promissory notes comprehends all the states that access to this convention. The Republic of Lithuania accessed that Convention in 1938. Geneva law of bills of exchange and promissory notes is compared with the Anglo-Saxon system of law with the intention to emphasize the main differences and similarities.
