ENIn the report, the arguments of supporters and opponents of death penalty are discussed in order to disclose their soundness and tightness. The author distributes the arguments of supporters of death penalty into five groups. The first group consists of arguments of supporters of death penalty where the right to an inviolability of life and the fact of a deprivation of life itself are stressed. The second group of arguments stresses the necessity to follow the aims of a penalty. In the third group of arguments the anxiety on an influence of death penalty upon the regime of the state is expressed. The fourth group of arguments discusses the problems of economical uselessness and discriminational character of death penalty. The fifth group includes arguments which stress expediency and irrevocability of death penalty as well as torturing character of it. The arguments of opponents of death penalty are reviewed more briefly, mostly in the form of retorts to abolitionists. After the analysis of the arguments of supporters and opponents of death penalty, it is stated in tbe report that in the philosophical dispute on a necessity of death penalty not only arguments of the abolitionists where an impossibility of deprivation of life of any person is stressed but also the arguments of retentionists where a necessity to ensure a safety of the society are important. Thus, it may be concluded thai neither the arguments of the supporters of death penalty nor the ones of the opponents are absolutely rightful and undeniable. In fact, they differ only in that whose life - of a felon or of imaginary future victims - is considered more protectable. Namely for this reason these arguments are very rarely important on passing a decision on an abolition of death penalty or a reintroduction of it.
