Summary / Abstract:

LTStraipsnyje siekiama apžvelgti kiekvieno asmens teisės žinoti apie tai, kokius jo sveikatos duomenis tvarko sveikatos priežiūros paslaugų teikėjai, reguliavimo ypatumus, kai šie duomenys tvarkomi informacinėmis technologijomis, bei kitų subjektų teisių gauti asmens sveikatos duomenis apimtį, taip pat argumentuoti, kodėl sveikatos duomenų tvarkymas naudojantis informacinėmis technologijomis yra neabejotinai teigiamas dalykas, padedantis geriau užtikrinti žmogaus teisę į privatumą ir sveikatos duomenų apsaugą. Pabrėžiama, kad praktika turi žengti kartu su teisėkūra, jog diegiant projektus neatsirastų spragų ar žmogaus teisių pažeidimų šioje jautrioje - sveikatos priežiūros - visuomenės ir kiekvieno žmogaus gyvenimo srityje.

ENThe aim of this article is to survey the regulative specifics of each person's right to know what category of personal health related data are being processed by healthcare service providers when such data are processed with the use of information technologies; the rights of other individuals to obtain personal health related information; also to provide argument that the processing of health information by using information technologies is, beyond doubt, a positive matter. Though this contributes to ensuring an individual's right to privacy and security of health related data, the practice should not lag behind the lawmaking in seeking to ensure that human rights are not violated in the course of carrying out the projects, and preventing the appearance of certain gaps related with this sensitive sphere in the life of our society and each person - the healthcare process. A particularly sensitive sphere is a patient's right to know what data are being processed, from where they are obtained, and to whom they are disclosed (provided). The health related data processed by information technologies should be systemised in compliance with the requirements laid down by legal acts, and if any irregularities are detected, the relevant lawmaking process ought to be accelerated. Apart from the right of the data subject to have access to his personal data and to know about the processing of the personal data, there is one more significant right related with the data subject's decision whether his personal data may or have to be provided.
