Summary / Abstract:

LTLietuvos Respublikos Seimo ir teismų aktuose bei akademinėje teisės literatūroje nuo 2004 m. dažniau vartojama kategorija „konstitucinė atsakomybė“. [...] Tokios kategorijos suvokimas reikšmingas teoriniu ir praktiniu požiūriu, atsižvelgiant į tai, kad: a) iki šiol diskutuojama apie Respublikos Prezidentui R. Paksui pritaikyto apkaltos proceso (ir jo padarinio: neterminuoto pasyviosios rinkimų teisės apribojimo) savitumą ir santykį su baudžiamąja atsakomybe; b) Lietuvos Aukščiausiasis Teismas 2005 m. gruodžio 13 d. nutartimi griežtai atribojo „institucijas, nagrinėjančias asmenų konstitucinės atsakomybės klausimus", ir bendrosios kompetencijos teismus, vertinančius asmenų baudžiamosios atsakomybės niuansus; c) šiais metais Seimas atstatydino... savo Pirmininką A. Paulauską, o Respublikos Prezidentas V Adamkus viešai pareiškė nepasitikėjimą dviem... jo paskirtais ministrais. Lietuvoje iki šiol nebuvo išsamesnių konceptualių publikacijų apie konstitucinės atsakomybės esmę ir ypatumus. Todėl gali susidaryti įspūdis, kad politikai, teisėjai, žurnalistai, teisės ar politikos mokslo atstovai, vartojantys žodžius „konstitucinė atsakomybė“, juos suvokia aprioriškai arba „priima“ eklektiškai. Kokia gi tų žodžių „juridinė substancija“? Kaip argumentuotai išsklaidyti abejones, ar konstitucinė atsakomybė yra „grynai“ teisinės atsakomybės rūšis, taigi nėra politinės atsakomybės atmaina? Ar rezonansinis trijų apylinkės teismų pirmininkų atleidimas Respublikos Prezidento 2003 m. liepos 22 d. dekretu už Konstitucijoje numatytą „teisėjo vardo“ pažeminimą yra konstitucinės atsakomybės taikymo (drausminės atsakomybės „nurungimo“) precedentas? Atsakyti į tokius ir panašius klausimus, taip pat užpildyti tyrinėjimų spragą ir skiriamas šis straipsnis. EN[…] The recent changes in the official legal doctrine of the Republic of Lithuania (i. e. the conclusion of the Constitutional Court of 31 March 2004 and the ruling of the Supreme Court of 13 December 2005) imply that an additional type of liability – constitutional liability – ought to be distinguished. Analysis of its forms and ways of expression (it may be expressed in appropriate constitutional sanctions or similar "measures of repression") shows that it is necessary to develop an "authentic" conception, i. e. based on the Constitution of the Republic of Lithuania of 1992. Its provisions enable to discern two main ("major") forms (structures) of constitutional liability: a) Constitutional political (or "constitutionalised" political) liability which may be applied by the Seimas in the cases and forms established by the Constitution in administering various "quasi-sanctions", e.g. individual expression of non-confidence in a minister or removal from office of the ombudsman, also introduction of direct governing for a local municipality, thus as if subjecting the municipality council to collective liability (in principle, a "purely" political aspect may not prevail in the latter case). It should be noted that such sanctions are imposed (i. е., an action is instituted) in absence of factual and formal grounds of liability and universal guarantees for effective judicial self-defence (i. e. the right of access to court) determined in advance by representatives of the judicial power.A similar interpretation can also be applicable for the instance established in the Constitution when the President of the Republic calls for premature elections on the grounds that the Seimas either failed to approve the programme of the Government or expressed non-confidence in its activity. […]; b) Constitutional legal liability, which may be applicable exclusively with the existence of factual and formal grounds of liability predetermined by representatives of the judicial power. The most distinctive "mini" form of the latter liability is the termination of the constitutional powers of the President of the Republic, a member of the Seimas or judges of the three highest level courts executed by a decision of the Seimas following a procedure of impeachment. This is quite clearly revealed and developed in the jurisprudence of the Constitutional Court. It should be considered whether it is conceptually possible to discern still other forms of constitutional liability which are expressed in particular "constitutional sanctions" and are not (cannot) be subject to essential modification in the provisions of the administrative or any other branch of law. In an attempt to find an answer to this question, it could be stated that the termination of judiciary powers by removing a judge from his office by a decree of the President of the Republic (upon the advice of a special institution of judiciary self-government – the Judiciary Council) for "an action demeaning the judicial office" is not a disciplinary but a constitutional sanction. This, however, gives rise to a number of theoretical ambiguities as these grounds for the removal of office are still defined in the Law on Courts as an aspect of judiciary disciplinary (hence, not constitutional) liability.
