Das Verhältnis von Staat und Kirchen in Litauen

LTBažnytinei teisei Lietuvoje iškyla sunkus, tačiau tuo pačiu labai įdomus uždavinys. Keičiant valdymo formą ir perorganizuojant santykius, pastaruoju metu žvelgiant į bendrą gyvenimą Europos sąjungoje, reikia spręsti problemas, kurios teisės tradicijoje ir bažnyčios organizacijoje vargu, ar įsivaizduojamos. Vis dar neįmanoma paprasčiausiai perimti užsienietiškus modelius, ypač, kai evangelikų bažnyčia Lietuvoje niekada nebuvo valstybine bažnyčia (net nebuvo tai svarstoma). Griežta perskyra tarp valstybės ir bažnyčios tėra iliuzija, kuri neatitinka nei valstybės, nei bažnyčios tikrovės. Dviejų sričių skirtumas ir ryšys triasmenio Dievo viešpatijoje yra svarbiausia sąlyga ne tik juristams, bet ir teologams, idant jie kartu išspręstų uždavinius, susijusius su bažnytine teise. Evangelikų bažnyčiai reikia ne naujos įstatyminės sutarties tarp valstybės ir bažnyčios, tačiau drąsos ir jėgos įrodyti valstybei, kad ji yra pasiruošusi spręsti bendrus uždavinius.Reikšminiai žodžiai: Bažnyčia; Valstybė.

ENThe Church law in Lithuania faces a difficult but nevertheless very interesting task. Changes in the form of government and the reorganization of relations, as well as the common life in the European Union, necessitate the solution of problems that are next to unimaginable in the legal tradition and the organization of the church. It is not possible to simply borrow foreign models, especially since the Evangelical Church in Lithuania has never been a state church (it was never even considered). The strict separation of the state and the Church is merely an illusion, which does not correspond to the reality of either the state or the Church. The division of the two realms and the relation in the domain of triune God is main condition not only for lawyers but also for theologians to jointly solve the tasks related to the Church law. The Evangelical Church needs not a new legal agreement between the state and the Church but only courage and power to prove to the state that it is ready to solve common tasks.
