Darbo ir socialinės teisės santykio problema: teorija ir praktika

LTStraipsnyje bandoma kiek kitu kampu pažvelgti į socialinę teisę, negu kad buvo ir vis dar tebėra įprasta teisės moksle. Autorius, siekdamas atskleisti teisės normų sistemą, kuria remiamasi vykdant socialinę politiką, pateikia naują teorinį modelį, apjungiantį į visumą tiek tiesiogines, tiek netiesiogines socialinės politikos įgyvendinimo priemones. Remiantis tokiu požiūriu galima atsakyti į klausimą, ar Lietuvoje sukurta ir ar veikia nuosekli ir išbaigta teisės normų, padedančių užtikrinti pakankamai aukštą socialinį standartą ir kartu išlaikyti visuomenės interesų balansą, visuma. Straipsnyje taip pat nagrinėjamas socialinės ir darbo teisės santykis.

ENArticle views social law from a somewhat different perspective than it used to be and continues to be common in legal science. With a view to revealing the system of legal norms which serves as a basis in implementing the social policy, the author uses a new theoretical model encompassing into a coherent whole direct and indirect measures of the implementation of the social policy. Such an approach makes it possible to provide a reply to the question as to whether a consistent and complete entirety of the legal norms helping to ensure a sufficiently high social standard and concurrently preserve a balance of public interests has been created and operates in Lithuania. The article also studies the relationship between social and labour law.
