Summary / Abstract:
ENThe article deals with the concept specification of narcotic drugs and psychotropic substances and their major features relevant to penal law. Present Lithuanian Republic Penal Code chapters (similarly as the chapters of both draft codes), defining penalties for drug-related crimes, do not stipulate penalty type and its severity corresponding to the substances affect and its degree on a person's health. In conclusion the author proposes to classify narcotic drugs and psychotropic substance according to the criteria - harmfulness to a human health and life, the harm degree (minor, substantial and major) that would empower to differentiate penalties and provide the application of alternative to imprisonment punishments.
