Garantinių išmokų ir priemokų sampratos ir atskyrimo problemos darbo teisėje

LTStraipsnyje analizuojamos garantinių išmokų ir priemokų sampratos bei atskyrimo nuo darbo užmokesčio ir kitų mokėjimų problemos. Būtina nurodyti, kad šiuo metu nei norminiuose aktuose, nei mokslinėje literatūroje nėra išsamiai ir vienodai apibrėžtos garantinių išmokų ir priemokų sąvokos, išskirti joms būdingi bruožai. Kai nėra aiškios šių garantijų formų sampratos, sunku jas atskirti nuo darbo užmokesčio, painiojamos tarpusavyje pačios garantinės išmokos ir priemokos. Straipsnyje, naudojant loginius ir lyginamosios analizės metodus, apžvelgiami norminiai aktai ir mokslinė literatūra, analizuojamos joje pateiktos garantinių išmokų ir priemokų sąvokos, jų teisinė prigimtis. Autorius išskiria joms būdingus požymius ir suformuluoja garantinių išmokų ir priemokų sąvokas. Taip išmokos ir priemokos yra atskiriamos nuo darbo užmokesčio ir viena nuo kitos.

ENProblems of guarantee payments’ and extra pays’ conception and their separation from wage and other forms of payments are analyzed in the article. It should note that at this moment there is no proper clarification of the conception of guarantee payments and guarantee extra pays in Laws or in legal science. It is hard to separate them from wage or one another without correct concept of these forms of employee guaranties. In the article different Laws, legal scientific literature and concept of guarantee payments and extra pays are compared and studied applying logical and comparative analysis methods. The author researches essential features and elements and formulates the concepts of the mentioned forms of payments. Using formulated features and concepts guarantee payments and extra pays are separated from the wage and from each other.
