Summary / Abstract:

LTStraipsnyje analizuojamas teisinis ne maisto produktų saugos reguliavimas Europos Sąjungos ir Lietuvos Respublikos lygmenimis. Siekiant sistemingai įvertinti produktų saugos kontrolės priemones, taikomas tiek Europos Sąjungos vidaus rinkoje, tiek nacionaliniu Lietuvos Respublikos lygmeniu, straipsnyje aptariamos svarbiausios iš jų. Straipsnyje taip pat pateikiama Valstybinės vartotojų teisių apsaugos tarnybos – vartotojų teisių apsaugos politiką įgyvendinančios institucijos, analizuojamoje srityje vykdančios keitimosi informacija apie pavojingus vartotojų sveikatai gaminius sistemos ryšių palaikymo institucijos bei atsakomybės už nesaugių produktų pateikimą į rinką taikymo funkcijas – patirtis, analizuojami aktualūs duomenys, formuojamos išvados dėl produktų saugos kontrolės tendencijų ir įgyvendinimo gerinimo.

ENControl of product safety and consumers‘ right to get and use safe and not hazard for health or life products becomes more and more important in the context of the functioning of the internal European Union market. A lot of attention in this area is reflected both in the legal regulation of product safety at the European Union and national levels as well as other measures designed to protect consumers from unsafe products, implementation. The presentation covers the analysis of the main legislation in the field of the general non-food products, the safety requirements at the European Union level, and discusses them also at the national level, the implementation of such legislation. Seeking systematically to evaluate the product safety control measures and means applied both at EU and national level i. e. in the Republic of Lithuania, in this topic are discussed the most important of them. One of them is the EU rapid alert system for all dangerous consumer products, with the exception of food, pharmaceutical and medical devices (RAPEX). It allows for the rapid exchange of information between Member States via central contact points and the Commission of measures taken to prevent or restrict the marketing or use of products posing a serious risk to the health and safety of consumers.In such way it is seeking to ensure more effective market surveillance and maximal risk deduction, caused realization by not safe products in the common market. In both EU and Lithuanian market it is noticed the increase of not safe product as the statistical data indicate. During this presentation the most important indicators effecting product safety and its reasons are separated and evaluated. Practical part of this presentation is focused on means of the product safety control in Lithuania and their application experience. The most important of these measures are analyzed in a more detailed way, distinguishing liability for the breach of legal acts regulating product safety and its practical aspects, relevant statistical data. In this presentation are also separated the most often breaches and their examples identified in a field of non food products safety during investigations of the State Consumer Rights Protection Authority of the Republic of Lithuania regarding breaches of the Law on Product safety.
