Prekinių kreditų draudimo sutarčių ypatumai

LTPasaulinės ekonominės krizės akivaizdoje Lietuvoje veikiančių kreditų draudikų veiksmai atšaukiant ir mažinant kreditų limitus, sulaukę neigiamos draudėjų ir net valstybės institucijų reakcijos, valstybės kuriamas eksporto skatinimo kreditų draudimu modelis verčia atkreipti dėmesį į specifinę prekinių kreditų draudimo sutartį, kuri daugeliui Lietuvos teisininkų tebėra terra incognita. Straipsnyje siekiama atskleisti prekinių kreditų draudimo sutarties esmę ir prigimtį bei draudėjo ir draudiko teisių ir pareigų ypatumus [Įvadas].

ENRecent financial crisis and consequent reaction of credit insurers (sharp decrease of trade credit limits) has drawn specific attention to the phenomenon of trade credit insurance. It appears that not every lawyer or finance director properly understands the specific features of this insurance agreement. The article aims to fill this gap. The analysis of specific features of trade credit insurance agreements results in the conclusion that a wider principle of the freedom of contract is recognised in the sphere of trade credit insurance. This is mainly because the parties to a contract are professionals in their respective fields (insurance and trade/production). Also, as trade credit insurance activity is extremely risky, strong adherence to the terms and conditions of the contract is material. Failure to follow contractual provisions leads to refusal of insurance indemnity. Finally, principles of international trade credit insurance (lex mercatoria) are of the outmost significance for the interpretation of trade credit insurance agreements.
