LTStraipsnyje tyrinėjamas kultūros paveldo atstatymo fenomenas. Dažnai kultūros paveldo objektų atstatymas prieštaravo paveldosaugos teisėje ir teoretikų veikaluose vyraujančiai paveldo atstatymo sampratai. Todėl tyrime aiškinamasi, kodėl ir kaip yra atstatomi tam tikri kultūros paveldo objektai ir vietos; kodėl ir kaip tarptautinėje paveldosaugos teisėje ir teorijoje kito požiūris į paveldo objektų atstatymą. Tarptautinėje paveldosaugos teisėje požiūris į kultūros paveldo objektų atstatymą kito. Venecijos chartijoje visi atstatymo darbai griežtai atmetami. Vis dėlto vėliau atstatymą ypatingais atvejais imta pateisinti. Tuo buvo pripažinta kultūros paveldo svarba formuojant nacionalinės ar kitos bendruomenės tapatumą. Dabartinėje Lietuvos paveldosaugos sistemoje pastebima painiava vartojant paveldosaugos sąvokas. Paveldosaugos teisėje įsigalėjusi atkūrimo sąvoka, skirta apibrėžti tikslų nebeegzistuojančio objekto atkūrimą, tampa komplikuota perkėlus ją į praktiką. Dažnai tikslus objekto atstatymas įvardijamas rekonstrukcijos, restauracijos, reabilitacijos, revitalizavimo, regeneracijos, istorinio įvaizdžio atkūrimo sąvokomis, griežtai neskiriant jų skirtingų prasmių. Tyrime pabrėžiama, kad paminkluose aktualizuota istorija yra paveldas, kuris įkūnija dvasines vertybes, tautos atmintį bei geba formuoti tapatybę. Būtinybė atstatyti prarastus objektus ar erdves, keliančius praeities asociacijų, ypač suaktyvėja kritiniais istorijos momentais. ENThe phenomenon of the restoration of cultural heritage is the object of analysis of the article. Usually the reconstruction of objects of cultural heritage conflicted with the concept of reconstruction, existing in the heritage law and works of theoreticians. Therefore, the study analyses why and how certain objects and places of cultural heritage are reconstructed, as well as why and how attitudes towards the reconstruction of heritage objects have changed in the international heritage protection law and theory. Attitudes towards the reconstruction of heritage objects have changed in the international law of heritage protection. In the Venice Charter all reconstruction works are strictly rejected. Nevertheless, reconstructions in exceptional cases were allowed. Thus an importance of cultural heritage in the formation of a national or other community’s identity was acknowledged. In the current Lithuanian system of heritage protection a misconception of the use of heritage protection has been observed. The term restoration provided in the heritage protection law and defined as an exact restoration of an object that no longer exists, becomes a complicated concept when put in practice. Usually an exact restoration of an object is called reconstruction, rehabilitation, revitalisation, regeneration or a restoration of a historical image, without a clear distinction of differences in meaning. The study highlights that the history actualised in monuments is heritage that embodies spiritual values, national memory and forms identity. A necessity to restore lost objects and spaces that trigger associations from the past become particularly intense in critical historical moments. Europe underwent such crises after World War II and the collapse of the Soviet Union.
