Parlamentinės kontrolės sąvokos, jų turinio interpretacija ir parlamentinės kontrolės formos
LTŠiuolaikinėse demokratinėse valstybėse egzistuoja įvairūs kontrolės mechanizmai. Parlamentinė kontrolė vienas iš svarbiausių kontrolės institutų demokratinėje valstybėje. Nepaisant parlamentinės kontrolės sąvokų įvairovės, parlamentinės kontrolės institutas – tai vienas iš valdžių padalijimo principo realizavimo mechanizmų elementų, užtikrinantis įstatymų leidžiamosios ir vykdomosios valdžios (vyriausybės) pusiausvyrą, bendradarbiavimą ir teisėtą bei veiksmingą, demokratinės valstybės valdžios įgyvendinimą. Atsižvelgiant į parlamentinės kontrolės sampratų įvairovę galima išskirti dvi parlamentinės kontrolės formas- politinę ir informacinę parlamentinės kontrolės formas. Politinės parlamentinės kontrolės formą sudaro visos priemonės susiejusios su vykdomosios valdžios (vyriausybės) parlamentine atsakomybe. Šiai formai reiktų priskirti visas kontrolės priemones, kurios leidžia atstatydinti, pareikšti nepasitikėjimą kontroliuojamam subjektui. Informacinei parlamentinės kontrolės formai- priskiriamos visos kitos priemonės, kurios leidžia parlamentui rinkti informaciją apie kontroliuojamą subjektą. Pagrindinė parlamentinės kontrolės doktrinoje pozicija, tik parlamentas, vykdydamas vykdomosios valdžios kontrolę, veikai kaip tautos atstovybė. Parlamentinė kontrolė tiesiogiai susijusi su tautos suvereniteto principo įgyvendinimu, todėl kontrolinė parlamento kompetencija beveik neribojama. [Iš leidinio]
ENThis publication has been prepared using the stenographical materials from the conference ‘Parliamentary control: reasoning and the problems of implementing it in Lithuania’, which was held in the Houses of Parliament of the Republic of Lithuania on 3 November 2005. The conference was attended by Artūras Paulauskas, the Chancellor, the Government, and representatives from the legal and academic spheres. […] The concepts of parliamentary control were read out at the conference, their content interpreted and the topics of parliamentary control, the appropriateness of controversial concepts such as parliamentary control and parliamentary review were discussed. The issues of parliamentary control in both broader and narrower senses were heard, as were the forms of parliamentary control: political and informative (procedural). […] Generalizing the positions laid out, parliamentary control can be understood in a broad sense and described as a process of parliamentary review managing the majority of parliament using regulatory means and (or) sanctions in order to influence directly or indirectly the government’s method of working and decision-making, the use of political means in case of need, which give rise to political consequences. These are forms of political control in a narrower sense, parliamentary control should be understood as a member of parliament […] intending to familiarise himself with the parliament’s activity with the aim of gathering information and conducting an analysis of the government’s activity in terms of the criteria of lawfulness and effectiveness which are stipulated in the constitution and regulations (the information form of parliamentary control).
