Šeimos susijungimo direktyvos perkėlimo į Lietuvos teisę ir įgyvendinimo problemos

LT2005 m. spalio 3 d. pasibaigė 2003 m. rugsėjo 22 d. Tarybos direktyvos Nr. 2003/86/EB dėl teisės į šeimos susijungimą (toliau – Šeimos susijungimo direktyva) perkėlimo į nacionalinę teisę terminas. Šis straipsnis yra trečiasis iš straipsnių ciklo apie ES prieglobsčio direktyvų perkėlimo į Lietuvos teisę ir įgyvendinimo problemas . Straipsnyje analizuojama Šeimos susijungimo direktyvos perkėlimo į Lietuvos teisę būklė, direktyvos nuostatų įtaka Lietuvos prieglobsčio teisės vystymuisi ir atkreipiamas dėmesys į vis dar neperkeltas arba netinkamai perkeltas direktyvos nuostatas bei praktines problemas, galinčias kilti taikant šią direktyvą. Šeimos susijungimo direktyva tiesiogiai nepriklauso prieglobsčio sričiai, tačiau direktyvoje yra specialus skyrius dėl pabėgėlių šeimos susijungimo, todėl jos vaidmuo svarbus garantuojant pabėgėlių šeimos gyvenimo apsaugą. Straipsnis gali būti naudingas direktyvos nuostatas taikančioms valstybės institucijoms bei įstatymų leidėjui siekiant garantuoti visišką direktyvos nuostatų perkėlimą į nacionalinę teisę, tobulinti dabartinę teisinę bazę Lietuvoje ir užtikrinti pagarbą užsieniečių šeimoms.

ENThe 3rd of October 2005 marks the deadline for the transposition of EU Council Directive No. 2003/86EC (hereinafter referred to as Family Reunification Directive) into the national legislation. This article is the third article in a series of articles on the transposition of the European Union Asylum Directives into the Lithuanian law and the problems related to the implementation thereof. The article analyses the transposition of the Family Reunification Directive into the Lithuanian law, the impact of the Directive’s provision on the development of Lithuanian asylum law and draws attention to the provisions, which have not been transpositioned or have been transpositioned improperly and to practical problems, which may emerge when applying this directive. The Family Reunification Directive does not directly belong to the asylum field, however, it has a special section on the reunification of refugees’ families, therefore, its role is very important when guaranteeing protection of refugees’ families. This article maybe useful for institutions applying provisions of the directive and the legislators seeking to guarantee full and proper transposition of the directive into the national legislation, improve the current legislation in Lithuania and ensure full respect to families of foreigners in the country.
